1.2relating to natural resources; appropriating money from the outdoor heritage fund.
1.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.OUTDOOR HERITAGE APPROPRIATION.
1.5The sums shown in the columns marked "Appropriations" are appropriated to the
1.6agencies and for the purposes specified in this act. The appropriations are from the outdoor
1.7heritage fund for the fiscal year indicated for each purpose. The figures "2014" and "2015"
1.8used in this act mean that the appropriations listed under the figure are available for the
1.9fiscal year ending June 30, 2014, and June 30, 2015, respectively. "The first year" is fiscal
1.10year 2014. "The second year" is fiscal year 2015. The "biennium" is fiscal years 2014 and
1.112015. The appropriations in this act are onetime.

2.2$2,000,000 in the first year is to the Board of
2.3Water and Soil Resources for a pilot project
2.4to acquire permanent conservation easements
2.5on grasslands in cooperation with the
2.6Minnesota Land Trust and the Conservation
2.7Fund. Up to $1,850,000 may be used
2.8for agreements with the Minnesota Land
2.9Trust to acquire permanent conservation
2.10easements and up to $75,000 may be used
2.11for establishing monitoring and enforcement
2.12funds with the Minnesota Land Trust and
2.13the Board of Water and Soil Resources,
2.14as approved in the accomplishment plan
2.15and subject to Minnesota Statutes, section
2.1697A.056, subdivision 17. Up to $75,000
2.17may be used for an agreement with the
2.18Conservation Fund for professional services.

Easement - Phase V

3.1086A.05, subdivision 8; acquire land in fee
3.11for scientific and natural area purposes

3.15section 84.96. Up to $42,000 is for
3.16establishing a monitoring and enforcement

3.31wetlands, and savanna. A list of proposed

3.33the required accomplishment plan. Annual
3.34income statements and balance sheets for
3.35income and expenses from land acquired
3.36with this appropriation must be submitted to
4.1the Lessard-Sams Outdoor Heritage Council

Phase III
4.6$3,520,000 in the first year is to the Board
4.7of Water and Soil Resources to acquire
4.8permanent conservation easements to protect
4.9and enhance habitat by expanding clean
4.10water fund riparian wildlife buffers on private
4.11land. Up to $120,000 is for establishing
4.12a monitoring and enforcement fund, as
4.13approved in the accomplishment plan and
4.14subject to Minnesota Statutes, section
4.1597A.056, subdivision 17. Easements funded
4.16under this appropriation are not subject to
4.17emergency haying and grazing orders. A list

11.35and St. Croix Rivers as follows: $450,000

12.2Refuge Trust, Inc.; $160,000 to the Friends

12.4River Greening; $450,000 to the Minnesota

12.28United States Fish and Wildlife Service
12.29to enhance aquatic habitat in the lower
12.30Mississippi River watershed. A list of
12.31proposed land restorations and enhancements
12.32must be provided as part of the required
12.33accomplishment plan.

(g) Coldwater Fish Habitat Enhancement -
Phase V
13.1$2,470,000 in the first year is to the
13.2commissioner of natural resources for an
13.3agreement with Minnesota Trout Unlimited
13.4to restore and enhance coldwater river and
13.5stream habitats in Minnesota. A list of
13.6proposed land restorations and enhancements
13.7must be provided as part of the required
13.8accomplishment plan.

(h) Albert Lea Lake Management and Invasive
Species Control Structure - Phase III
13.11$1,127,000 in the first year is to the
13.12commissioner of natural resources for
13.13an agreement with the Shell Rock River
13.14Watershed District to construct structural
13.15deterrents and lake level controls to enhance
13.16aquatic habitat on Albert Lea Lake in
13.17Freeborn County. A list of proposed
13.18land restorations and enhancements
13.19must be provided as part of the required
13.20accomplishment plan.

(i) Outdoor Heritage Conservation Partners
Grant Program - Phase V
13.23$3,860,000 in the first year is to the
13.24commissioner of natural resources for a
13.25program to provide competitive, matching
13.26grants of up to $400,000 to local, regional,
13.27state, and national organizations for
13.28enhancing, restoring, or protecting forests,
13.29wetlands, prairies, and habitat for fish, game,
13.30or wildlife in Minnesota. Grants shall not
13.31be made for activities required to fulfill
13.32the duties of owners of lands subject to
13.33conservation easements. Grants shall not be
13.34made from appropriations in this paragraph
13.35for projects that have a total project cost
13.36exceeding $575,000. Of this appropriation,
14.1$366,000 may be spent for personnel costs
14.2and other direct and necessary administrative
14.3costs. Grantees may acquire land or interests
14.4in land. Easements must be permanent.
14.5Land acquired in fee must be open to
14.6hunting and fishing during the open season
14.7unless otherwise provided by state law. The
14.8program shall require a match of at least ten
14.9percent from nonstate sources for all grants.
14.10The match may be cash or in-kind resources.
14.11For grant applications of $25,000 or less,
14.12the commissioner shall provide a separate,
14.13simplified application process. Subject to
14.14Minnesota Statutes, the commissioner of
14.15natural resources shall, when evaluating
14.16projects of equal value, give priority to
14.17organizations that have a history of receiving
14.18or charter to receive private contributions
14.19for local conservation or habitat projects. If
14.20acquiring land or a conservation easement,
14.21priority shall be given to projects associated
14.22with existing wildlife management areas
14.23under Minnesota Statutes, section 86A.05,
14.24subdivision 8; scientific and natural areas
14.25under Minnesota Statutes, sections 84.033
14.26and 86A.05, subdivision 5; and aquatic
14.27management areas under Minnesota Statutes,
14.28sections 86A.05, subdivision 14, and 97C.02.
14.29All restoration or enhancement projects
14.30must be on land permanently protected by a
14.31conservation easement or public ownership
14.32or in public waters as defined in Minnesota
14.33Statutes, section 103G.005, subdivision
14.3415. Priority shall be given to restoration
14.35and enhancement projects on public lands.
14.36Minnesota Statutes, section 97A.056,
15.1subdivision 13, applies to grants awarded
15.2under this paragraph. This appropriation is
15.3available until June 30, 2017. No less than
15.4five percent of the amount of each grant
15.5must be held back from reimbursement until
15.6the grant recipient has completed a grant
15.7accomplishment report by the deadline and
15.8in the form prescribed by and satisfactory to
15.9the Lessard-Sams Outdoor Heritage Council.
15.10The commissioner shall provide notice of
15.11the grant program in the game and fish law
15.12summaries that are prepared under Minnesota
15.13Statutes, section 97A.051, subdivision 2.

Subd. 6.Administration

(a) Contract Management
15.16$175,000 in the first year is to the
15.17commissioner of natural resources for
15.18contract management duties assigned in this
15.19section. The commissioner shall provide an
15.20accomplishment plan in the form specified by
15.21the Lessard-Sams Outdoor Heritage Council
15.22on the expenditure of this appropriation.
15.23The accomplishment plan must include
15.24a copy of the grant contract template
15.25and reimbursement manual. No money
15.26may be expended prior to Lessard-Sams
15.27Outdoor Heritage Council approval of the
15.28accomplishment plan.

(b) Legislative Coordinating Commission
15.30$936,000 in the first year is to the Legislative
15.31Coordinating Commission for administrative
15.32expenses of the Lessard-Sams Outdoor
15.33Heritage Council and for compensation and
15.34expense reimbursement of council members.
15.35Funds in this appropriation are available until
16.1June 30, 2015. Minnesota Statutes, section
16.216A.281, applies to this appropriation.

(c) Technical Evaluation Panel
16.4$45,000 in the first year is to the
16.5commissioner of natural resources for a
16.6technical evaluation panel to conduct up to
16.7ten restoration evaluations under Minnesota
16.8Statutes, section 97A.056, subdivision 10.

(d) High-Priority Pre-Transaction Service
Acceleration for Lessard-Sams Outdoor
Heritage Council
16.12$50,000 in the first year is to the
16.13commissioner of natural resources to provide
16.14land acquisition pre-transaction services
16.15including, but not limited to, appraisals,
16.16surveys, or title research for acquisition
16.17proposals under consideration by the
16.18Lessard-Sams Outdoor Heritage Council. A
16.19list of activities must be included in the final
16.20accomplishment plan.

(e) Legacy Web Site
16.22$15,000 the first year is for the Legislative
16.23Coordinating Commission for the Web site
16.24required in Minnesota Statutes, section
16.253.303, subdivision 10.

Subd. 7.Availability of Appropriation
16.27Money appropriated in this section may
16.28not be spent on activities unless they are
16.29directly related to and necessary for a
16.30specific appropriation and are specified in
16.31the accomplishment plan approved by the
16.32Lessard-Sams Outdoor Heritage Council.
16.33Money appropriated in this section must
16.34not be spent on indirect costs or other
16.35institutional overhead charges that are not
17.1directly related to and necessary for a specific
17.2appropriation. Unless otherwise provided,
17.3the amounts in this section are available
17.4until June 30, 2016. For acquisition of real
17.5property, the amounts in this section are
17.6available until June 30, 2017, if a binding
17.7agreement with a landowner or purchase
17.8agreement is entered into by June 30, 2016,
17.9and closed no later than June 30, 2017. Funds
17.10for restoration or enhancement are available
17.11until June 30, 2018, or four years after
17.12acquisition, whichever is later, in order to
17.13complete initial restoration or enhancement
17.14work. If a project receives federal funds, the
17.15time period of the appropriation is extended
17.16to equal the availability of federal funding.

Subd. 8.Payment Conditions and Capital
Equipment Expenditures
17.25All agreements referred to in this section must
17.26be administered on a reimbursement basis
17.27unless otherwise provided in this section.
17.28Notwithstanding Minnesota Statutes, section
17.2916A.41, expenditures directly related
17.30to each appropriation's purpose made
17.31on or after July 1, 2013, or the date of
17.32accomplishment plan approval, whichever is
17.33later, are eligible for reimbursement unless
17.34otherwise provided in this section. For the
17.35purposes of administering appropriations
17.36and legislatively authorized agreements
18.1paid out of the outdoor heritage fund, an
18.2expense must be considered reimbursable
18.3by the administering agency when the
18.4recipient presents the agency with an invoice
18.5or binding agreement with the landowner
18.6and the recipient attests that the goods have
18.7been received or the landowner agreement
18.8is binding. Periodic reimbursement must
18.9be made upon receiving documentation that
18.10the items articulated in the accomplishment
18.11plan approved by the Lessard-Sams Outdoor
18.12Heritage Council have been achieved,
18.13including partial achievements as evidenced
18.14by progress reports approved by the
18.15Lessard-Sams Outdoor Heritage Council.
18.16Reasonable amounts may be advanced to
18.17projects to accommodate cash flow needs,
18.18support future management of acquired
18.19lands, or match a federal share. The
18.20advances must be approved as part of the
18.21accomplishment plan. Capital equipment
18.22expenditures for specific items in excess of
18.23$10,000 must be itemized in and approved as
18.24part of the accomplishment plan.

Subd. 9.Mapping
18.26Each direct recipient of money appropriated
18.27in this section, as well as each recipient of
18.28a grant awarded pursuant to this section,
18.29must provide geographic information to
18.30the Department of Natural Resources for
18.31mapping any lands acquired in fee with
18.32funds appropriated in this section and open
18.33to public taking of fish and game. The
18.34commissioner of natural resources shall
18.35include the lands acquired in fee with
18.36money appropriated in this section on maps
19.1showing public recreation opportunities.
19.2Maps shall include information on and
19.3acknowledgement of the outdoor heritage
19.4fund, including a notation of any restrictions.

Subd. 10.Appropriations carryforward; fee
title acquisition
19.7The availability of the appropriation for the
19.8following project is extended to July 1, 2015:
19.9Laws 2010, chapter 361, article 1, section
19.102, subdivision 5, paragraph (h), Washington
19.11County St. Croix River Land Protection, and
19.12the appropriation may be spent on acquisition
19.13of land in fee title to protect habitat associated
19.14with the St. Croix River Valley. A list of
19.15proposed acquisitions must be provided as
19.16part of the accomplishment plan.
