1.1A bill for an act
1.2relating to the permanent school fund; modifying the membership of the advisory
1.3committee;amending Minnesota Statutes 2010, section 127A.30, subdivision 1.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 127A.30, subdivision 1, is amended to
1.6read:
1.7    Subdivision 1. Membership and terms. (a) A state Permanent School Fund
1.8Advisory Committee is established to advise the Department of Natural Resources on
1.9the management of permanent school fund land, which is held in trust for the school
1.10districts of the state.
1.11(b) The advisory committee must consist of the following persons or their designees:
1.12the chairs of the education committees of the legislature, the chairs of the legislative
1.13committees with jurisdiction over the K-12 education budget, the chairs of the legislative
1.14committees with jurisdiction over the environment and natural resources policy and
1.15budget, the chair of the senate Committee on Finance and the chair of the house of
1.16representatives Committee on Ways and Means, one house member of the minority
1.17party appointed by the minority leader, one senator of the minority party appointed
1.18pursuant to the rules of the senate, the commissioner of education, one superintendent
1.19from a nonmetropolitan district, one superintendent from a metropolitan area district, one
1.20person with expertise on school finance matters, one person with an expertise in forestry,
1.21one person with an expertise in minerals and mining, one person with an expertise in
1.22real estate development, one person with an expertise in renewable energy, one person
1.23with an expertise in finance and land management, and one person with an expertise in
1.24natural resource conservation. The school district superintendents shall be appointed
2.1by the commissioner of education. The committee members with areas of expertise in
2.2forestry, minerals and mining, real estate development, renewable energy, finance and land
2.3management, and natural resource conservation shall be appointed by the commissioner of
2.4natural resources. Members of the legislature shall be given the opportunity to recommend
2.5candidates for vacancies on the committee to the commissioners of education and natural
2.6resources. The advisory committee must also include a nonvoting member appointed
2.7by the commissioner of natural resources.
2.8(c) The commissioner of natural resources shall provide administrative support to
2.9the committee.
2.10(d) The members of the committee shall serve without compensation. The members
2.11of the Permanent School Fund Advisory Committee shall elect their chair and are bound
2.12by the provisions of sections 43A.38 and 116P.09, subdivision 6.
2.13(e) The terms of members appointed by the commissioners of education and natural
2.14resources are staggered four-year terms according to section 15.059, subdivision 2.
2.15Members may be reappointed at the pleasure of the appointing authority. Members are
2.16subject to removal according to section 15.059, subdivision 4.
2.17(f) The other members of the Permanent School Fund Advisory Committee serve
2.18at the pleasure of their respective appointing authorities and their terms expire upon the
2.19appointment of their successors.
2.20EFFECTIVE DATE.This section is effective the day following final enactment.
