1.1A bill for an act
1.2relating to energy; abolishing prohibition on issuing certificate of need for new
1.3nuclear power plant; prohibiting plutonium weapon reprocessing;amending
1.4Minnesota Statutes 2010, section 216B.243, subdivision 3b, by adding a
1.5subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 216B.243, subdivision 3b, is amended to
1.8read:
1.9    Subd. 3b. Nuclear power plant; new construction prohibited; relicensing
1.10Additional storage of spent nuclear fuel. (a) The commission may not issue a certificate
1.11of need for the construction of a new nuclear-powered electric generating plant.
1.12(b) Any certificate of need for additional storage of spent nuclear fuel for a facility
1.13seeking a license extension shall address the impacts of continued operations over the
1.14period for which approval is sought.
1.15EFFECTIVE DATE.This section is effective the day following final enactment.

1.16    Sec. 2. Minnesota Statutes 2010, section 216B.243, is amended by adding a
1.17subdivision to read:
1.18    Subd. 3c. Nuclear plant; plutonium weapon reprocessing prohibition. The
1.19commission may not issue a certificate of need for a new nuclear-powered electric
1.20generating plant if it finds that the applicant plans to reprocess spent fuel produced by the
1.21proposed plant into weapons-grade plutonium either at the plant or elsewhere in the state.
1.22EFFECTIVE DATE.This section is effective the day following final enactment.
