1.1A bill for an act
1.2relating to children's health; prohibiting sale of children's food containers
1.3containing bisphenol-A;proposing coding for new law in Minnesota Statutes,
1.4chapter 325F.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [325F.174] BISPHENOL-A IN CHILDREN'S FOOD CONTAINERS.
1.7    Subdivision 1. Prohibition. (a) Beginning August 1, 2014, no manufacturer or
1.8wholesaler may knowingly sell or offer for sale in this state infant formula, baby food, or
1.9toddler food stored in a container that contains intentionally added bisphenol-A.
1.10(b) Beginning August 1, 2015, no retailer may knowingly sell or offer for sale in
1.11this state infant formula, baby food, or toddler food stored in a container that contains
1.12intentionally added bisphenol-A.
1.13    Subd. 2. Definitions. For purposes of this section, the following terms have the
1.14meanings given.
1.15(a) "Baby food" means a prepared solid food consisting of a soft paste or an easily
1.16chewed food that is intended for consumption by children two years of age or younger
1.17and is commercially available.
1.18(b) "Container" means a receptacle, box, can, or jar, including a lid, that is in direct
1.19physical contact with a children's food.
1.20(c) "Infant formula" means a liquid or powder that purports to be or is represented
1.21for special dietary use solely as a food for infants by reason of its simulation of human
1.22milk or its suitability as a complete or partial substitute for human milk.
2.1(d) "Toddler food" means any food or beverage, other than baby food or infant
2.2formula, that is intended for consumption by children under three years of age. For
2.3purposes of this section, toddler food in can containers is not included in this definition.
2.4EFFECTIVE DATE.This section is effective the day following final enactment.

2.5    Sec. 2. [325F.175] BISPHENOL-A REPLACEMENT CHEMICALS.
2.6Beginning August 1, 2014, a manufacturer shall not replace a chemical the use of
2.7which is prohibited in section 325F.174 with a chemical known to the manufacturer to
2.8have been identified on the basis of credible scientific evidence by a state, federal, or
2.9international agency as being known or suspected with a high degree of probability to:
2.10(1) harm the normal development of a fetus or child or cause other developmental
2.11toxicity;
2.12(2) cause cancer, genetic damage, or reproductive harm;
2.13(3) disrupt the endocrine or hormone system; or
2.14(4) damage the nervous system, immune system, or organs, or cause other systemic
2.15toxicity.
2.16EFFECTIVE DATE.This section is effective the day following final enactment.
