1.2relating to state lands; authorizing private sale of certain consolidated
1.3conservation lands.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. PRIVATE SALE OF CONSOLIDATED CONSERVATION LAND;
1.6MARSHALL COUNTY.
1.7(a) Notwithstanding the classification and public sale provisions of Minnesota
1.8Statutes, chapters 84A, 97A, and 282, Marshall County may sell by private sale to the
1.9adjoining landowner the consolidated conservation lands that are described in paragraph
1.10(c).
1.11(b) The conveyance must be in a form approved by the attorney general. The
1.12attorney general may make necessary changes to the legal description to correct errors
1.13and ensure accuracy. The consideration for the conveyance must be for no less than the
1.14appraised value of the land and timber and survey costs. Proceeds shall be disposed of
1.15according to Minnesota Statutes, chapter 84A.
1.16(c) The land to be sold is in Marshall County and is described as:
1.17(1) starting on the northeast corner of the Southeast Quarter, a strip of land 33 feet
1.18wide extending to the South to a point 440 feet North of the southeast corner of the
1.19Southeast Quarter of Section 34, Township 156 North, Range 40 West;
1.20(2) starting at the northwest corner of the Southeast Quarter, a strip of land 33 feet
1.21wide extending to the East to a point 880 feet West of the northeast corner of the Southeast
1.22Quarter of Section 34, Township 156 North, Range 40 West;
2.1(3) starting at the northwest corner of the South Half of the Southwest Quarter a
2.2strip of land 33 feet wide extending to the East to a point 1,320 feet East of the northwest
2.3corner of the Southwest Quarter of Section 34, Township 156 North, Range 40 West; and
2.4(4) a strip of land 33 feet wide on the South side of the Northeast Quarter of the
2.5Northeast Quarter of Section 2, Township 155 North, 40 West.
2.6(d) The land was recently surveyed and property boundaries corrected. The land to
2.7be conveyed contains drainage ditches of the adjoining landowner and the public interest
2.8would be best served if the land was returned to private ownership.
