1.1A bill for an act
1.2relating to military affairs; allowing active duty service members to take a peace
1.3officer reciprocity examination; amending Minnesota Statutes 2012, section
1.4626.8517.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 626.8517, is amended to read:
1.7626.8517 ELIGIBILITY FOR RECIPROCITY EXAMINATION BASED ON
1.8RELEVANT MILITARY EXPERIENCE.
1.9(a) For purposes of this section:
1.10(1) "active service" has the meaning given in section 190.05, subdivision 5; and
1.11(2) "relevant military experience" means:
1.12(i) five years' active service experience in a military law enforcement occupational
1.13specialty;
1.14(ii) three years' active service experience in a military law enforcement occupational
1.15specialty, and completion of a two-year or more degree from a regionally accredited
1.16postsecondary education institution; or
1.17(iii) five years' cumulative experience as a full-time peace officer in another state
1.18combined with active service experience in a military law enforcement occupational
1.19specialty.
1.20(b) A person who has relevant military experience and who is eligible to take the
1.21reciprocity examination if the person has relevant military experience and:
1.22(1) has been honorably discharged from military active service as evidenced by a
1.23form DD-214 is eligible to take the reciprocity examination.; or
1.24(2) is currently in active service as evidenced by:
2.1(i) active duty orders providing service time in military police specialty;
2.2(ii) a United States Department of Defense Manpower Data Center status report
2.3pursuant to Service Members Civil Relief Act, active duty status report; or
2.4(iii) Military Personnel Center assignment information.
2.5(c) A person who passed the examination under paragraph (b), clause (2), shall
2.6not be eligible to be licensed as a peace officer until honorably discharged as evidenced
2.7by a form DD-214.
