1.2relating to local government; specifying requirements for ordinances establishing
1.3responsibility for maintenance of water service pipes; adding definitions;
1.4amending Minnesota Statutes 2012, section 444.075, subdivision 1, by adding a
1.5subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2012, section 444.075, subdivision 1, is amended to read:
1.8 Subdivision 1. Definitions. The definitions in this subdivision apply in this section.
1.9(a) "Municipality" means a home rule charter or statutory city or a town that is not in
1.10an orderly annexation process on October 3, 1989.
1.11(b) "Governing body" means the town board with respect to towns.
1.12(c) "Waterworks" means waterworks systems, including mains, valves, hydrants,
1.13service connections, wells, pumps, reservoirs, tanks, treatment plants, and other
1.14appurtenances of a waterworks system.
1.15(d) "Sanitary sewer" means sanitary sewer systems, including sewage treatment
1.16works, disposal systems, and other facilities for disposing of sewage, industrial waste, or
1.17other wastes.
1.18(e) "Storm sewer" means storm sewer systems, including mains, holding areas
1.19and ponds, and other appurtenances and related facilities for the collection and disposal
1.20of storm water.
1.21(f) "Facilities" means and includes waterworks, sanitary sewer and storm sewer
1.22systems, or any portion or portions thereof.
1.23(g) "Curb stop" means a water service valve that has been installed by a municipality
1.24to turn water service off and on to a building and is located in a water service pipe near the
1.25curb and between the water main and the building receiving water service.
2.1(h) "Water main" means the principal pipe artery to which water service pipes may
2.2be connected.
2.3(i) "Water service pipe" means the pipe from the water main to the water distributing
2.4system of the building served.
2.5 Sec. 2. Minnesota Statutes 2012, section 444.075, is amended by adding a subdivision
2.6to read:
2.7 Subd. 7. Ordinances; responsibility for maintenance of water service pipes. A
2.8municipality must not enact, amend, or enforce an ordinance that establishes private
2.9ownership and responsibility for maintenance of water service pipes from the point of
2.10connection at a building receiving water service to the municipal water main. A local
2.11ordinance may establish private ownership and responsibility for maintenance of water
2.12service pipes from the point of connection at the building receiving water service to the
2.13curb stop or property line. A local ordinance contrary to this subdivision is void.
