1.1A bill for an act
1.2relating to manufactured homes; establishing remedies and a lien for park owners
1.3when a home is abandoned; amending Minnesota Statutes 2010, section 327C.11,
1.4by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 327C.11, is amended by adding a
1.7subdivision to read:
1.8    Subd. 5. Abandoned home; claim and lien of park owner. (a) This subdivision
1.9applies if a resident abandons a manufactured home on the lot. The owner has a claim
1.10against the resident and a landlord lien against the manufactured home for reasonable
1.11costs and expenses incurred in securing, caring for, storing, and removing or transporting
1.12the manufactured home to a suitable place for storage, if the home is not stored on its
1.13existing lot, and for the lot rent and other charges accrued that are not paid by a secured
1.14party as provided under section 327C.08. Notwithstanding section 504B.365, the owner
1.15has a lien under this subdivision regardless of whether the manufactured home is removed
1.16from the lot.
1.17(b) Except as otherwise provided in this paragraph, sections 514.18 to 514.22,
1.18including the provisions applicable to motor vehicles, apply to the sale of a manufactured
1.19home to enforce a lien under this subdivision. Notwithstanding the time periods in section
1.20514.20, if the amount secured by the lien has not been paid by the resident, the sale may
1.21occur no earlier than 28 days after execution of the order to vacate or, if a secured creditor
1.22is listed on the certificate of title and the amount secured by the lien has not been paid by a
1.23secured creditor, no earlier than 45 days after the written notice has been provided to all
1.24secured creditors listed on the certificate of title, as provided under section 514.20.

2.1    Sec. 2. EFFECTIVE DATE; APPLICATION.
2.2This section is effective August 1, 2011, and applies to manufactured homes
2.3abandoned on or after that date.
