1.1A bill for an act
1.2relating to state lands; authorizing conveyance of certain tax-forfeited land that
1.3borders public water.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. CONVEYANCE OF TAX-FORFEITED LAND BORDERING PUBLIC
1.6WATER; CARVER COUNTY.
1.7(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
1.8and the public sale provisions of Minnesota Statutes, chapter 282, Carver County may
1.9convey to the city of Norwood Young America for less than the appraised value the
1.10tax-forfeited land bordering public water that is described in paragraph (c).
1.11(b) The conveyance must be in a form approved by the attorney general and provide
1.12that the land reverts to the state if the city of Norwood Young America stops using the
1.13land for the public purpose described in paragraph (d). The attorney general may make
1.14changes to the land description to correct errors and ensure accuracy.
1.15(c) The land to be conveyed is located in Carver County and is described as: Outlot
1.16A, The Preserve 3rd Addition (parcel 58.6520890).
1.17(d) The county has determined that the land is needed by the city of Norwood Young
1.18America for a public park or lake access.

1.19    Sec. 2. PRIVATE SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
1.20WATER; CARVER COUNTY.
1.21(a) Notwithstanding Minnesota Statutes, sections 92.45, 282.01, subdivision 1, and
1.22282.018, subdivision 1, and the public sale provisions of Minnesota Statutes, section
1.23282, Carver County may sell by private sale the tax-forfeited lands bordering public
2.1water that are described in paragraph (c) under the remaining provisions of Minnesota
2.2Statutes, section 282.
2.3(b) The conveyance must be in a form approved by the attorney general. The
2.4attorney general may make necessary changes to the legal description to correct errors and
2.5ensure accuracy. The county may convey the land to the city of Watertown for less than
2.6the market value of the land as determined by the county board, but the conveyance must
2.7provide that the land described in paragraph (c) be used for a public use, as described in
2.8Minnesota Statutes, section 282.01, subdivision 1a, which may include but is not limited
2.9to a park, trails system, public transit system facility, and public service facility, which
2.10may include a water tower, administrative offices, a lift station, and a public works facility,
2.11as well as use in a wetland bank restoration project as defined in Minnesota Statutes,
2.12sections 103G.222 to 103G.2243, in which a conditional use deed or deed restrictions may
2.13be recorded. The land described in paragraph (c) may be subsequently subdivided and
2.14conveyed, in whole or in part, to other local governmental subdivisions of the state to
2.15accomplish these public uses. The land described in paragraph (c) is subject to the reverter
2.16interest of the state pursuant to Minnesota Statutes, section 282.01, subdivisions 1c and 1d.
2.17(c) The lands to be sold are located in Carver County and are described as:
2.18the South Half of Southeast Quarter of Section 9, Township 117, Range 25, Carver
2.19County, Minnesota, except those parts described as follows, to wit: commencing at
2.20the southwest corner of Southeast Quarter of said Section 9; thence running North
2.2160 rods to a point in the center of the Watertown, Chaska and Carver Road; thence
2.22southeasterly 73 rods to south line of said Southeast Quarter; thence West 44 rods to
2.23place of beginning. EXCEPTING THEREFROM that part of the South Half of the
2.24Southeast Quarter of Section 9, Township 117 North, Range 25 West, Carver County,
2.25Minnesota, described as follows: commencing at the South Quarter corner of Section
2.269; thence on an assumed bearing of East along the south line of said Southeast
2.27Quarter 726.00 feet (44 rods) to the point of beginning of the tract to be described;
2.28thence North 36 degrees 59 minutes 00 seconds West along a line that would
2.29intersect the west line of said Southeast Quarter at a point 990.00 feet (60 rods)
2.30North of said South Quarter corner a distance of 267.81 feet; thence on a bearing of
2.31East a distance of 493.23 feet; thence on a bearing of South 1 degree 30 minutes 00
2.32seconds West a distance of 214.00 feet to said south line of the Southeast Quarter;
2.33thence on a bearing of West a distance of 326.52 feet to the actual point of beginning;
2.34ALSO EXCEPTING THEREFROM that part of the South Half of the Southeast
2.35Quarter of Section 9, Township 117 North, Range 25 West of the Fifth Principal
2.36Meridian, described as follows: commencing at the southwest corner of said
3.1Southeast Quarter; thence on an assumed bearing of East along the south line of said
3.2Southeast Quarter a distance of 726.00 feet; thence North 37 degrees 04 minutes 30
3.3seconds West, along a line that will intersect the west line of said Southeast Quarter
3.4at a point 990.00 feet northerly from said southwest corner of the Southeast Quarter,
3.5a distance of 267.81 feet; thence on a bearing of East a distance of 273.66 feet to the
3.6point of beginning of the land to be described; thence continuing on a bearing of
3.7East a distance of 219.57 feet; thence on a bearing of South 1 degree 30 minutes
3.800 seconds West to said south line of the Southeast Quarter; thence on a bearing of
3.9East along said south line a distance of 236.23 feet; thence on a bearing of North a
3.10distance of 556.20 feet; thence on a bearing of West a distance of 65.27 feet; thence
3.11South 48 degrees 20 minutes 11 seconds West a distance of 515.27 feet to the point
3.12of beginning; ALSO EXCEPTING THEREFROM all that part of the Southwest
3.13Quarter of the Southeast Quarter of Section 9, Township 117 North, Range 25 West,
3.14Carver County, Minnesota, lying southwesterly of the southwesterly right-of-way
3.15line of County State-Aid Highway No. 10, as described in Document No. 58827,
3.16as recorded in the office of the Carver County Recorder; ALSO EXCEPTING
3.17THEREFROM that part thereof platted as Tuscany Village (PIN No. 85.0092900).
3.18(d) The county has determined that the county's land management interests would
3.19best be served if the land were conveyed to the city of Watertown for the use described in
3.20paragraph (b).
3.21EFFECTIVE DATE.This section is effective the day following final enactment.
