1.1A bill for an act
1.2relating to public safety; drivers' licenses; making placement of residence
1.3addresses on drivers' licenses optional; eliminating the fee charged to change
1.4the residence address on a driver's license record; establishing a computerized
1.5records system; authorizing Internet access; specifying system access
1.6requirements;amending Minnesota Statutes 2012, sections 171.07, subdivisions
1.71, 3; 171.11; 171.12, by adding a subdivision; 171.121.
1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.9    Section 1. Minnesota Statutes 2012, section 171.07, subdivision 1, is amended to read:
1.10    Subdivision 1. License; contents. (a) Upon the payment of the required fee, the
1.11department shall issue to every qualifying applicant a license designating the type or class
1.12of vehicles the applicant is authorized to drive as applied for. This license must bear a
1.13distinguishing number assigned to the licensee; the licensee's full name and date of birth;
1.14either (1) the licensee's residence address, or (2) the designated address under section
1.155B.05; a description of the licensee in a manner as the commissioner deems necessary;
1.16and the usual signature of the licensee; and, if the licensee requests, either the licensee's
1.17residence address or designated address under section 5B.05. No license is valid unless it
1.18bears the usual signature of the licensee. Every license must bear a colored photograph
1.19or an electronically produced image of the licensee. Even if the residence or designated
1.20address is not displayed on a licensee's license, the licensee's residence or designated
1.21address must be retained and stored in the department's record system.
1.22    (b) If the United States Postal Service will not deliver mail to the applicant's
1.23residence address as listed on the license, then the applicant shall provide verification from
1.24the United States Postal Service that mail will not be delivered to the applicant's residence
1.25address and that mail will be delivered to a specified alternate mailing address. When an
2.1applicant provides an alternate mailing address under this subdivision, the commissioner
2.2shall use the alternate mailing address in lieu of the applicant's residence address for
2.3all notices and mailings to the applicant.
2.4    (c) Every license issued to an applicant under the age of 21 must be of a
2.5distinguishing color and plainly marked "Under-21."
2.6    (d) The department shall use processes in issuing a license that prohibit, as nearly as
2.7possible, the ability to alter or reproduce a license, or prohibit the ability to superimpose a
2.8photograph or electronically produced image on a license, without ready detection.
2.9    (e) A license issued to an applicant age 65 or over must be plainly marked "senior" if
2.10requested by the applicant.

2.11    Sec. 2. Minnesota Statutes 2012, section 171.07, subdivision 3, is amended to read:
2.12    Subd. 3. Identification card; fee. (a) Upon payment of the required fee, the
2.13department shall issue to every qualifying applicant a Minnesota identification card. The
2.14department may not issue a Minnesota identification card to an individual who has a
2.15driver's license, other than a limited license. The department may not issue an enhanced
2.16identification card to an individual who is under 16 years of age, not a resident of this
2.17state, or not a citizen of the United States of America. The card must bear a distinguishing
2.18number assigned to the applicant; a colored photograph or an electronically produced
2.19image of the applicant; the applicant's full name and date of birth; either (1) the licensee's
2.20residence address, or (2) the designated address under section 5B.05; a description of the
2.21applicant in the manner as the commissioner deems necessary; and the usual signature
2.22of the applicant; and, if the applicant requests, either the applicant's residence address or
2.23designated address under section 5B.05.
2.24    (b) If the United States Postal Service will not deliver mail to the applicant's
2.25residence address as listed on the Minnesota identification card, then the applicant shall
2.26provide verification from the United States Postal Service that mail will not be delivered
2.27to the applicant's residence address and that mail will be delivered to a specified alternate
2.28mailing address. When an applicant provides an alternate mailing address under this
2.29subdivision, the commissioner shall use the alternate mailing address in lieu of the
2.30applicant's residence address for all notices and mailings to the applicant.
2.31    (c) Each identification card issued to an applicant under the age of 21 must be of a
2.32distinguishing color and plainly marked "Under-21."
2.33    (d) Each Minnesota identification card must be plainly marked "Minnesota
2.34identification card - not a driver's license."
3.1    (e) The fee for a Minnesota identification card is 50 cents when issued to a person
3.2who is developmentally disabled, as defined in section 252A.02, subdivision 2; a
3.3physically disabled person, as defined in section 169.345, subdivision 2; or, a person with
3.4mental illness, as described in section 245.462, subdivision 20, paragraph (c).

3.5    Sec. 3. Minnesota Statutes 2012, section 171.11, is amended to read:
3.6171.11 DUPLICATE LICENSE; CHANGE OF DOMICILE OR NAME.
3.7When any person, after applying for or receiving a driver's license, shall change
3.8permanent domicile from the address named in such application or in the license issued to
3.9the person, or shall change a name by marriage or otherwise, such person shall, within
3.1030 days thereafter, apply for a duplicate driver's license upon a form furnished by the
3.11department and pay the required fee or using the computerized records system under section
3.12171.12, subdivision 1a. The application or duplicate license shall show both the licensee's
3.13old address and new address or the former name and new name as the case may be.

3.14    Sec. 4. Minnesota Statutes 2012, section 171.12, is amended by adding a subdivision
3.15to read:
3.16    Subd. 1a. Computerized records system; access to address information. (a) The
3.17department shall maintain a computerized records system of the residence address or
3.18designated address for all driver's license and identification card applicants.
3.19(b) The record shall be Internet accessible by applicants, who may use the system to
3.20change the residence address or designated address of record associated with the applicant's
3.21driver's license or identification card. In order to access the system, the applicant must
3.22provide the applicant's driver's license number or identification card number, birth date,
3.23and any other security code or measure the department deems appropriate.
3.24(c) Subdivision 7 applies to the data maintained in the computerized records system
3.25under paragraph (a).

3.26    Sec. 5. Minnesota Statutes 2012, section 171.121, is amended to read:
3.27171.121 USE OF ANOTHER'S RESIDENCE ADDRESS.
3.28A person may notify the commissioner in writing to the effect that the person (1) is
3.29the owner of a residence, and (2) does not consent to have that residence address identified
3.30on any driver's license or identification card or driving record of the department as the
3.31residence address or permanent mailing address of any person named in the notice. The
3.32notice may not name a spouse of the notifying person. Upon receiving the notice the
3.33commissioner shall not issue any license or identification card under this chapter, or
4.1accept an application for a license or identification card under this chapter, that lists the
4.2residence address identified in the notice as the residence address or permanent mailing
4.3address of any person named in the notice.

4.4    Sec. 6. EFFECTIVE DATE.
4.5Sections 1 to 5 are effective August 1, 2016.
