1.1A resolution
1.2opposing Environmental Protection Agency regulations that would expand federal
1.3jurisdiction over waters and lands without Congressional approval.
1.4WHEREAS, the United States Environmental Protection Agency (EPA) is in the process of
1.5finalizing regulations that would significantly expand federal jurisdiction over waters and lands
1.6pursuant to the 1972 Federal Water Pollution Control (Clean Water) Act; and
1.7WHEREAS, with bipartisan support, Congress has rejected legislation that proposed to
1.8expand federal jurisdiction over the 1972 Act; and
1.9WHEREAS, since 2001, the United States Supreme Court, on at least four occasions, has
1.10ruled to limit federal jurisdiction under the 1972 Act; and
1.11WHEREAS, the Minnesota Legislature has, on several occasions, supported state and local
1.12alternatives to federal authority over lands and waters, including bipartisan approval of a state
1.13water rights statute in 1995; NOW, THEREFORE,
1.14BE IT RESOLVED by the Legislature of the State of Minnesota that it opposes EPA
1.15regulations that would expand federal jurisdiction over lands and waters without approval by
1.16Congress.
1.17BE IT FURTHER RESOLVED that the Minnesota Legislature requests that the governor
1.18and Minnesota's Senators and Representatives in Congress publicly express their support for
1.19this resolution.
1.20BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is
1.21directed to prepare enrolled copies of this memorial and transmit them to the President of the
2.1United States, the President and the Secretary of the United States Senate, the Speaker and
2.2the Clerk of the United States House of Representatives, the chair of the Senate Committee
2.3on Environment and Public Works, the chairs of the House Transportation and Infrastructure
2.4Committee and Water Resources and Environment subcommittee, and Minnesota's Senators
2.5and Representatives in Congress.
