1.1A bill for an act
1.2relating to agriculture; eliminating state preemption of certain pesticide control
1.3ordinances for cities of the first class;amending Minnesota Statutes 2012, section
1.418B.02.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 18B.02, is amended to read:
1.718B.02 PREEMPTION OF LOCAL LAW.
1.8(a) Except as provided in paragraph (b) or as otherwise specifically provided in this
1.9chapter, the provisions of this chapter preempt ordinances by local governments that
1.10prohibit or regulate any matter relating to the registration, labeling, distribution, sale,
1.11handling, use, application, or disposal of pesticides. It is not the intent of this section to
1.12preempt local responsibilities for zoning, fire codes, or hazardous waste disposal.
1.13(b) An ordinance adopted and enforced by a city of the first class that prohibits
1.14or regulates any matter relating to the use, application, or disposal of pesticides is not
1.15preempted by the provisions of this chapter.
