1.1A bill for an act
1.2relating to education; providing for a student's resident district as a basis for open
1.3enrollment decisions;amending Minnesota Statutes 2010, section 124D.03,
1.4subdivision 6.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 124D.03, subdivision 6, is amended to
1.7read:
1.8    Subd. 6. Basis for decisions. The board must adopt, by resolution, specific
1.9standards for acceptance and rejection of applications. Standards may include the
1.10capacity of a program, class, or school building, or the student's district of residence. The
1.11school board may not reject applications for enrollment in a particular grade level if the
1.12nonresident enrollment at that grade level does not exceed the limit set by the board under
1.13subdivision 2. Standards may not include previous academic achievement, athletic or
1.14other extracurricular ability, disabling conditions, proficiency in the English language,
1.15or previous disciplinary proceedings, or the student's district of residence.
