1.1A bill for an act
1.2relating to health; requiring screening of newborns for critical congenital heart
1.3disease;proposing coding for new law in Minnesota Statutes, chapter 144.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [144.1251] NEWBORN SCREENING FOR CRITICAL CONGENITAL
1.6HEART DISEASE.
1.7(a) Each licensed hospital or state-licensed birthing center or facility that provides
1.8maternity and newborn care services shall provide screening for critical congenital heart
1.9disease (CCHD) to all newborns prior to discharge using pulse oximetry screening or other
1.10appropriate screening protocols for CCHD as established by the Minnesota Department of
1.11Health. This screening must be done no sooner than 24 hours after birth, unless earlier
1.12screening is deemed clinically appropriate, but always prior to discharge from the nursery.
1.13If discharge or transport of the newborn occurs prior to 24 hours after birth, screening
1.14must occur as close as possible to the time of discharge or transport. For premature infants
1.15who are less than 36 weeks of gestation and newborns admitted to a higher level nursery
1.16such as special care or intensive care, screening must be performed when medically
1.17appropriate prior to discharge. Any newborn that fails the screening must be referred
1.18to a licensed physician who shall arrange follow-up diagnostic testing and medically
1.19appropriate treatment prior to discharge from the hospital.
1.20(b) The commissioner shall adopt any necessary rules to implement the requirements
1.21in this section.
2.1EFFECTIVE DATE.This section is effective the day following final enactment.
2.2Screening shall take effect 180 days following final enactment or by December 31, 2012,
2.3whichever is sooner.
