1.1A bill for an act
1.2relating to food safety; requiring labeling of genetically engineered food;
1.3providing criminal penalties;amending Minnesota Statutes 2010, section 31.01,
1.4by adding a subdivision; proposing coding for new law in Minnesota Statutes,
1.5chapter 31.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 31.01, is amended by adding a subdivision
1.8to read:
1.9    Subd. 33. Genetically engineered organism. "Genetically engineered organism"
1.10has the meaning given in section 18F.02, subdivision 5.

1.11    Sec. 2. [31.1215] GENETICALLY ENGINEERED FOOD.
1.12    Subdivision 1. Label required. No person shall sell, distribute, or offer for sale a
1.13food if it contains a genetically engineered organism, or was produced with a genetically
1.14engineered organism, unless it bears a label that provides the following disclosure
1.15notice in boldface print of not less than ten-point type: "THIS PRODUCT CONTAINS
1.16A GENETICALLY ENGINEERED ORGANISM, OR WAS PRODUCED WITH A
1.17GENETICALLY ENGINEERED ORGANISM."
1.18    Subd. 2. Classification. A food shall be considered to have been produced with a
1.19genetically engineered organism if:
1.20(1) the organism from which the food is derived has been injected or has otherwise
1.21been treated with a genetically engineered organism;
1.22(2) the animal from which the food is derived has been fed a genetically engineered
1.23organism; or
1.24(3) the food contains an ingredient that is a food to which clause (1) or (2) applies.
2.1    Subd. 3. Exceptions. This section shall not apply to food served in restaurants or
2.2other establishments where food is served for immediate human consumption.
2.3    Subd. 4. Methodologies. The commissioner shall establish methodologies
2.4necessary for the purposes of this section, including the testing of food to determine the
2.5presence of a genetically engineered organism.
2.6    Subd. 5. Penalty. A person who violates this section is guilty of a misdemeanor.
2.7EFFECTIVE DATE.This section is effective for food sold, offered for sale, or
2.8distributed after January 1, 2013.
