1.1A bill for an act
1.2relating to health; modifying the cancer surveillance system data reported;
1.3amending Minnesota Statutes 2012, section 144.672, subdivision 1.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 144.672, subdivision 1, is amended to read:
1.6    Subdivision 1. Rule authority. (a) The commissioner of health shall collect cancer
1.7incidence information, analyze the information, and conduct special studies designed to
1.8determine the potential public health significance of an increase in cancer incidence.
1.9The commissioner shall adopt rules to administer the system, collect information,
1.10and distribute data. The rules must include, but not be limited to, the following:
1.11(1) the type of data to be reported;
1.12(2) standards for reporting specific types of data;
1.13(3) payments allowed to hospitals, pathologists, and registry systems to defray their
1.14costs in providing information to the system;
1.15(4) criteria relating to contracts made with outside entities to conduct studies using
1.16data collected by the system. The criteria may include requirements for a written protocol
1.17outlining the purpose and public benefit of the study, the description, methods, and
1.18projected results of the study, peer review by other scientists, the methods and facilities
1.19to protect the privacy of the data, and the qualifications of the researcher proposing to
1.20undertake the study; and
1.21(5) specification of fees to be charged under section 13.03, subdivision 3, for all
1.22out-of-pocket expenses for data summaries or specific analyses of data requested by
1.23public and private agencies, organizations, and individuals, and which are not otherwise
2.1included in the commissioner's annual summary reports. Fees collected are appropriated
2.2to the commissioner to offset the cost of providing the data.
2.3(b) In addition to the data reported under paragraph (a), the commissioner shall
2.4request that the following information be reported:
2.5(1) all previous occupations, dates, and places of work of a cancer patient; and
2.6(2) the time and place of any military service performed by a cancer patient.
