1.1A bill for an act
1.2relating to civil actions; regulating the liability of certain municipal employees;
1.3amending Minnesota Statutes 2010, section 466.04, subdivision 1a.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 466.04, subdivision 1a, is amended to read:
1.6    Subd. 1a. Officers and employees. The liability of an officer or an employee
1.7of any municipality for a tort arising out of an alleged act or omission occurring in the
1.8performance of duty shall not exceed the limits set forth in subdivision 1, unless the
1.9officer or employee provides professional services and also is employed in the profession
1.10for compensation by a person or persons other than the municipality, at the time of the
1.11alleged act or omission, was acting in a professional capacity, for compensation, outside of
1.12the officer's or employee's municipal employment or position.
1.13EFFECTIVE DATE.This section is effective August 1, 2012, and applies to
1.14actions arising from incidents occurring on or after that date.
