1.2relating to transportation; highways; regulating stormwater holding ponds;
1.3proposing coding for new law in Minnesota Statutes, chapter 160.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [160.202] HOLDING POND.
1.6A road authority may not maintain a holding pond, including but not limited to a
1.7detention pond or a retention pond, within the road right-of-way unless the pond is:
1.8(1) designed with a maximum depth of three feet following peak discharge from
1.9weather events; or
1.10(2) separated from all adjacent roadways by a cable median barrier, or other traffic
1.11barrier, capable of preventing a motor vehicle from entering the pond when traveling at
1.12speeds typical for the adjacent road.
1.13EFFECTIVE DATE.This section is effective the day following final enactment.
1.14 Sec. 2. ROAD AUTHORITIES; HOLDING POND IMPLEMENTATION.
1.15(a) For purposes of this section, "road authority" has the meaning given under
1.16Minnesota Statutes, section 160.02, subdivision 25.
1.17(b) Notwithstanding Minnesota Statutes, section 160.202, a road authority shall
1.18meet the requirements under that section by November 1, 2015, for any holding pond
1.19established before the effective date of this act.
1.20EFFECTIVE DATE.This section is effective the day following final enactment.
