1.2relating to human services; establishing data practices requirements for entities
1.3participating in the integrated health care delivery network pilot program;
1.4amending Minnesota Statutes 2012, section 13.461, by adding a subdivision;
1.5Minnesota Statutes 2013 Supplement, section 256B.0756.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2012, section 13.461, is amended by adding a
1.8subdivision to read:
1.9 Subd. 32. Integrated health care delivery network pilot program. Data sharing or
1.10dissemination of certain data on individuals by organizations or entities participating in the
1.11integrated health care delivery network pilot program is governed by section 256B.0756.
1.12 Sec. 2. Minnesota Statutes 2013 Supplement, section 256B.0756, is amended to read:
1.13256B.0756 HENNEPIN AND RAMSEY COUNTIES PILOT PROGRAM.
1.14(a) The commissioner, upon federal approval of a new waiver request or amendment
1.15of an existing demonstration, may establish a pilot program in Hennepin County or Ramsey
1.16County, or both, to test alternative and innovative integrated health care delivery networks.
1.17(b) Individuals eligible for the pilot program shall be individuals who are eligible
1.18for medical assistance under section 256B.055 and who reside in Hennepin County
1.19or Ramsey County. The commissioner may identify individuals to be enrolled in the
1.20Hennepin County pilot program based on zip code in Hennepin County or whether the
1.21individuals would benefit from an integrated health care delivery network.
1.22(c) Individuals enrolled in the pilot program shall be enrolled in an integrated
1.23health care delivery network in their county of residence. The integrated health care
2.1delivery network in Hennepin County shall be a network, such as an accountable care
2.2organization or a community-based collaborative care network, created by or including
2.3Hennepin County Medical Center. The integrated health care delivery network in Ramsey
2.4County shall be a network, such as an accountable care organization or community-based
2.5collaborative care network, created by or including Regions Hospital.
2.6(d) In developing a payment system for the pilot programs, the commissioner shall
2.7establish a total cost of care for the recipients enrolled in the pilot programs that equals
2.8the cost of care that would otherwise be spent for these enrollees in the prepaid medical
2.9assistance program.
2.10(e) The commissioner shall apply to the federal government for, or as appropriate,
2.11cooperate with counties, providers, or other entities that are applying for any applicable
2.12grant or demonstration under the Patient Protection and Affordable Health Care Act,
2.13Public Law 111-148, or the Health Care and Education Reconciliation Act of 2010, Public
2.14Law 111-152, that would further the purposes of or assist in the creation of an integrated
2.15health care delivery network for the purposes of thissubdivision section, including, but
2.16not limited to, a global payment demonstration or the community-based collaborative
2.17care network grants.
2.18(f) Organizations or entities participating in the integrated health care delivery
2.19network pilot program established by this section may share or disseminate the following
2.20data on individuals enrolled in the pilot program:
2.21(1) data related to an individual's eligibility for or receipt of welfare or other social
2.22services benefits; and
2.23(2) data contained in an individual's health records, to the extent permitted by
2.24federal law.
2.25Data may only be shared with or disseminated to other organizations or entities
2.26participating in the integrated health care delivery network, to the extent necessary to
2.27implement the requirements of the pilot program.
