1.1A bill for an act
1.2relating to corrections; requiring certain notifications to inmates who are
1.3veterans; proposing coding for new law in Minnesota Statutes, chapters 243; 641.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [243.95] INTAKE NOTIFICATION; DISABLED VETERANS.
1.6Upon initial intake of an individual to a correctional facility following conviction
1.7of a felony and sentencing for more than 60 days, the commissioner must attempt
1.8to identify any inmates who receive service-related disability payments from the
1.9Department of Veterans Affairs. If an inmate receives a service-related disability benefit,
1.10the commissioner must notify the inmate of the inmate's duty to report the inmate's
1.11incarceration to the commissioner of veterans affairs. The commissioner shall furnish VA
1.12form 21-4138 to an inmate receiving a service-related disability benefit, and provide the
1.13inmate with a reasonable opportunity to notify the inmate's county veteran services officer
1.14or the commissioner of veterans affairs.
1.15EFFECTIVE DATE.The section is effective the day following final enactment.

1.16    Sec. 2. [641.051] INTAKE NOTIFICATION; DISABLED VETERAN.
1.17Upon initial intake of an individual to a county or regional jail following conviction
1.18of a felony and a sentence of at least 60 days, the sheriff must attempt to identify
1.19any inmates who receive a service-related disability payment from the Department of
1.20Veterans Affairs. If the sheriff identifies an inmate who receives service-related disability
1.21payments, the sheriff must notify the inmate of the inmate's duty to report the inmate's
1.22incarceration to the commissioner of veterans affairs. The sheriff shall furnish VA form
2.121-4138 to an inmate receiving a service-related disability benefit, and provide the inmate
2.2with a reasonable opportunity to notify the inmate's county veteran services officer or the
2.3commissioner of veterans affairs.
2.4EFFECTIVE DATE.This section is effective the day following final enactment.
