1.2relating to metropolitan transit; expanding scope of jurisdiction of Transportation
1.3Accessibility Advisory Committee;amending Minnesota Statutes 2012, sections
1.4473.375, by adding a subdivision; 473.386, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 473.375, is amended by adding a
1.7subdivision to read:
1.8 Subd. 9a. Transportation Accessibility Advisory Committee. The council shall
1.9establish a Transportation Accessibility Advisory Committee consisting of 15 members
1.10and a chair to advise the council on the development and management of policies regarding
1.11accessibility of all aspects of fixed regular route and special transportation services for
1.12persons with disabilities. The Transportation Accessibility Advisory Committee shall also
1.13advise the council on long-range plans to meet the accessible transportation needs of the
1.14disability community. The Transportation Accessibility Advisory Committee must include
1.15elderly persons, persons with disabilities, other users of special transportation services, and
1.16representatives of appropriate agencies for elderly persons and persons with disabilities. At
1.17least half the Transportation Accessibility Advisory Committee members must be persons
1.18who are both ADA-certified and users of public transit in the metropolitan area. Two of
1.19the appointments to the Transportation Accessibility Advisory Committee must be made
1.20by the Council on Disability in consultation with the chair of the Metropolitan Council.
1.21 Sec. 2. Minnesota Statutes 2012, section 473.386, subdivision 2, is amended to read:
1.22 Subd. 2. Service contracts; management; transportation accessibility advisory
1.23committee. (a) The council may contract for services necessary for the provision of
2.1special transportation. Transportation service provided under a contract must specify the
2.2service to be provided, the standards that must be met, and the rates for operating and
2.3providing special transportation services.
2.4 (b) The council shall establish management policies for the service and may contract
2.5with a service administrator for day-to-day administration and management of the service.
2.6Any contract must delegate to the service administrator clear authority to administer and
2.7manage the delivery of the service pursuant to council management policies and must
2.8establish performance and compliance standards for the service administrator. The council
2.9may provide directly day to day administration and management of the service and may
2.10own or lease vehicles used to provide the service.
2.11 (c) The council shall ensure that the service administrator establishes a system for
2.12registering and expeditiously responding to complaints by users, informing users of how
2.13to register complaints, and requiring providers to report on incidents that impair the safety
2.14and well-being of users or the quality of the service.
2.15 (d) The council shall report on its special transportation services as part of the
2.16program evaluation provided for in section473.13, subdivision 1a .
2.17 (e) The council shall provide, on an annual basis, an opportunity for users and
2.18other interested persons to provide testimony to the council concerning services provided
2.19under this section.
2.20(f) The council shall establish a Transportation Accessibility Advisory Committee
2.21consisting of 15 members and a chair to advise the council on management policies for
2.22the council's special transportation service. The Transportation Accessibility Advisory
2.23Committee must include elderly and disabled persons, other users of special transportation
2.24service, and representatives of appropriate agencies for elderly and disabled persons. At
2.25least half the Transportation Accessibility Advisory Committee members must be persons
2.26who are both ADA-certified and users of public transit in the metropolitan area. Two of
2.27the appointments to the Transportation Accessibility Advisory Committee shall be made

2.29 Sec. 3. EFFECTIVE DATE.
2.30Sections 1 and 2 are effective the day following final enactment.
