1.1A bill for an act
1.2relating to human services; adjusting long-term care provider payments to reflect
1.3the cost of assessments under the Affordable Care Act;proposing coding for new
1.4law in Minnesota Statutes, chapter 256B.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [256B.5017] LONG-TERM CARE PROVIDER CONTINGENT
1.7PAYMENT ADJUSTMENT.
1.8    Subdivision 1. Contingent payment adjustment. The commissioner shall increase
1.9payments to long-term care providers by an amount equal to the dollar value of any
1.10assessable payments a long-term care provider is subject to as part of the employer
1.11shared responsibility requirements under section 1513 of the Affordable Care Act. The
1.12commissioner, in consultation with long-term care providers, shall develop a process
1.13and timeline for reporting and verifying assessable payments and increasing provider
1.14payment rates.
1.15    Subd. 2. Definitions. (a) For purposes of this section, the following definitions apply.
1.16(b) "Affordable Care Act" means Public Law 111-148, as amended by the federal
1.17Health Care and Education Reconciliation Act of 2010 (Public Law 111-152), and any
1.18amendments to, or regulations or guidance issued under, those acts.
1.19(c) "Long-term care provider" means a nursing facility, intermediate care facility
1.20for persons with developmental disabilities, housing with services establishment, or
1.21a provider of home care, private duty nursing, personal care assistant, or home and
1.22community-based waivered services.
