1.1A bill for an act
1.2relating to transportation; motor vehicles; adding service branch designs to
1.3special veterans' plates; amending Minnesota Statutes 2010, section 168.123,
1.4subdivision 2; Minnesota Statutes 2011 Supplement, section 168.123, subdivision
1.51.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2011 Supplement, section 168.123, subdivision 1,
1.8is amended to read:
1.9    Subdivision 1. General requirements; fees. (a) On payment of a fee of $10 for
1.10each set of two plates, or for a single plate in the case of a motorcycle plate, payment of
1.11the registration tax required by law, and compliance with other applicable laws relating to
1.12vehicle registration and licensing, as applicable, the commissioner shall issue:
1.13(1) special veteran's plates to an eligible applicant who served in the active
1.14military service in a branch of the armed forces of the United States or of a nation or
1.15society allied with the United States in conducting a foreign war, was discharged under
1.16honorable conditions, and is a registered owner of a passenger automobile as defined in
1.17section 168.002, subdivision 24, self-propelled recreational motor vehicle as defined in
1.18section 168.002, subdivision 27, or one-ton pickup truck as defined in section 168.002,
1.19subdivision 21b
, but which is not a commercial motor vehicle as defined in section
1.20169.011, subdivision 16 ; or
1.21(2) a veteran's special motorcycle plate as described in subdivision 2, paragraph (a),
1.22(f), (h), (i), or (j), or another special plate designed by the commissioner, to an eligible
1.23applicant who is a registered owner of a motorcycle as defined in section 168.002,
1.24subdivision 19
, and meets the criteria listed in this paragraph and in subdivision 2,
1.25paragraph (a), (f), (h), (i), or (j).
2.1(b) Special motorcycle plates issued under this paragraph (a), clause (2), must be the
2.2same size as regular motorcycle plates. Special motorcycle license plates issued under this
2.3clause, and are not subject to section 168.1293.
2.4(c) A special motorcycle plate is not available for the plate design specified in
2.5subdivision 2, paragraph (b), (c), (d), (e), (g), (k), or (l).
2.6(b) (d) The additional fee of $10 is payable for each set of veteran's plates, is payable
2.7only when the plates are issued, and is not payable in a year in which validation stickers
2.8are issued instead of plates.
2.9(c) (e) The veteran must have a certified copy of the veteran's discharge papers,
2.10indicating character of discharge, at the time of application. If an applicant served in the
2.11active military service in a branch of the armed forces of a nation or society allied with the
2.12United States in conducting a foreign war and is unable to obtain a record of that service
2.13and discharge status, the commissioner of veterans affairs may certify the applicant as
2.14qualified for the veterans' plates provided under this section.
2.15(d) (f) For license plates issued for one-ton trucks described in paragraph (a), clause
2.16(1), the commissioner shall collect a surcharge of $5 on each $10 fee collected under
2.17paragraph (a). The surcharge must be deposited in the vehicle services operating account
2.18in the special revenue fund.
2.19(g) For purposes of this subdivision, "eligible applicant" means an applicant for a
2.20special plate under this section who:
2.21(1) served in the active military service in a branch of the armed forces of the United
2.22States or of a nation or society allied with the United States in conducting a foreign war;
2.23(2) unless otherwise specified, was discharged under honorable conditions; and
2.24(3) meets the eligibility requirements for the specific plate design requested, as
2.25specified under subdivision 2.
2.26EFFECTIVE DATE.This section is effective January 1, 2013.

2.27    Sec. 2. Minnesota Statutes 2010, section 168.123, subdivision 2, is amended to read:
2.28    Subd. 2. Design and plate eligibility. The commissioner of veterans affairs
2.29shall design the emblem for the veterans' special plates, subject to the approval of the
2.30commissioner, that satisfy the following requirements:
2.31(a) For a Vietnam veteran who served after July 1, 1961, and before July 1, 1978,
2.32in the active military service in a branch of the armed forces of the United States or a
2.33nation or society allied with the United States the special plates must bear the inscription
2.34"VIETNAM VET" and the letters "V" and "V" with the first letter directly above the
2.35second letter and both letters just preceding the first numeral of the special plate number.
3.1(b) For a veteran stationed on the island of Oahu, Hawaii, or offshore, during the
3.2attack on Pearl Harbor on December 7, 1941, the special plates must bear the inscription
3.3"PEARL HARBOR SURVIVOR" and the letters "P" and "H" with the first letter directly
3.4above the second letter and both letters just preceding the first numeral of the special
3.5plate number.
3.6(c) For a veteran who served during World War I or World War II, the plates must
3.7bear the inscription "WORLD WAR VET" and:
3.8(1) for a World War I veteran, the characters "W" and "I" with the first character
3.9directly above the second character and both characters just preceding the first numeral
3.10of the special plate number; or
3.11(2) for a World War II veteran, the characters "W" and "II" with the first character
3.12directly above the second character and both characters just preceding the first numeral of
3.13the special plate number.
3.14(d) For a veteran who served during the Korean Conflict, the special plates must
3.15bear the inscription "KOREAN VET" and the letters "K" and "V" with the first letter
3.16directly above the second letter and both letters just preceding the first numeral of the
3.17special plate number.
3.18(e) For a combat wounded veteran who is a recipient of the Purple Heart medal, the
3.19plates must bear the inscription "COMBAT WOUNDED VET" and have a facsimile or an
3.20emblem of the official Purple Heart medal and the letters "C" over "W" with the first letter
3.21directly over the second letter just preceding the first numeral of the special plate number.
3.22A member of the United States armed forces who is serving actively in the military and
3.23who is a recipient of the Purple Heart medal is also eligible for this license plate. The
3.24commissioner of public safety shall ensure that information regarding the required proof
3.25of eligibility for any applicant under this paragraph who has not yet been issued military
3.26discharge papers is distributed to the public officials responsible for administering this
3.27section.
3.28(f) For a Persian Gulf War veteran, the plates must bear the inscription "GULF
3.29WAR VET" and the letters "G" and "W" with the first letter directly above the second
3.30letter and both letters just preceding the first numeral of the special plate number. For
3.31the purposes of this section, "Persian Gulf War veteran" means a person who served on
3.32active duty after August 1, 1990, in a branch of the armed forces of the United States or
3.33a nation or society allied with the United States or the United Nations during Operation
3.34Desert Shield, Operation Desert Storm, or other military operation in the Persian Gulf
3.35area combat zone as designated in United States Presidential Executive Order No. 12744,
3.36dated January 21, 1991.
4.1(g) For a veteran who served in the Laos War after July 1, 1961, and before July 1,
4.21978, the special plates must bear the inscription "LAOS WAR VET" and the letters "L"
4.3and "V" with the first letter directly above the second letter and both letters just preceding
4.4the first numeral of the special plate number.
4.5(h) For a veteran who is the recipient of:
4.6(1) the Iraq Campaign Medal, the special plates must be inscribed with a facsimile of
4.7that medal and must bear the inscription "IRAQ WAR VET" directly below the special
4.8plate number;
4.9(2) the Afghanistan Campaign Medal, the special plates must be inscribed with a
4.10facsimile of that medal and must bear the inscription "AFGHAN WAR VET" directly
4.11below the special plate number;
4.12(3) the Global War on Terrorism Expeditionary Medal, the special plates must
4.13be inscribed with a facsimile of that medal and must bear the inscription "GWOT
4.14VETERAN" directly below the special plate number; or
4.15(4) the Armed Forces Expeditionary Medal, the special plates must bear an
4.16appropriate inscription that includes a facsimile of that medal.
4.17(i) For a veteran who is the recipient of the Global War on Terrorism Service Medal,
4.18the special plates must be inscribed with a facsimile of that medal and must bear the
4.19inscription "GWOT VETERAN" directly below the special plate number. In addition,
4.20any member of the National Guard or other military reserves who has been ordered to
4.21federally funded state active service under United States Code, title 32, as defined in
4.22section 190.05, subdivision 5b, and who is the recipient of the Global War on Terrorism
4.23Service Medal, is eligible for the license plate described in this paragraph, irrespective of
4.24whether that person qualifies as a veteran under section 197.447.
4.25(j) For a veteran who is the recipient of the Korean Defense Service Medal,
4.26the special plates must be inscribed with a facsimile of that medal and must bear the
4.27inscription "KOREAN DEFENSE SERVICE" directly below the special plate number.
4.28(k) For a veteran who is a recipient of the Bronze Star medal, the plates must bear
4.29the inscription "BRONZE STAR VET" directly below the special plate number and have a
4.30facsimile or an emblem of the official Bronze Star medal.
4.31(l) For a veteran who is a recipient of the Silver Star medal, the plates must bear
4.32the inscription "SILVER STAR VET" directly below the special plate number and have a
4.33facsimile or an emblem of the official Silver Star medal.
4.34(m) For a veteran who served:
5.1(1) in the Army service branch, the plates must bear the inscription "U.S. ARMY
5.2VET" directly below the special plate number and have a facsimile or an emblem of
5.3that branch;
5.4(2) in the Marine Corps service branch, the plates must bear the inscription "U.S.
5.5MARINE VET" directly below the special plate number and have a facsimile or an
5.6emblem of that branch;
5.7(3) in the Navy service branch, the plates must bear the inscription "U.S. NAVY
5.8VET" directly below the special plate number and have a facsimile or an emblem of
5.9that branch;
5.10(4) in the Air Force service branch, the plates must bear the inscription "U.S. AIR
5.11FORCE VET" directly below the special plate number and have a facsimile or an emblem
5.12of that branch; and
5.13(5) in the Coast Guard service branch, the plates must bear the inscription "U.S.
5.14COAST GUARD VET" directly below the special plate number and have a facsimile or
5.15an emblem of that branch.
5.16EFFECTIVE DATE.This section is effective March 1, 2013.
