1.2relating to education finance; modifying the postsecondary enrollment options
1.3program;amending Minnesota Statutes 2012, section 124D.09, subdivision 9.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2012, section 124D.09, subdivision 9, is amended to read:
1.6 Subd. 9. Enrollment priority. A postsecondary institution shall give priority to its
1.7postsecondary students when enrolling 10th, 11th, and 12th grade pupils in its courses.
1.8A postsecondary institution may provide information about its programs to a secondary
1.9school or to a pupil or parent and it may advertise or otherwise recruit or solicit a
1.10secondary pupil to enroll in its programs on educational and programmatic grounds only.
1.11An institution must not enroll secondary pupils, for postsecondary enrollment options
1.12purposes, in remedial, developmental, or other courses that are not college level, except
1.13when a student eligible to participate in the graduation incentives program under section
1.14124D.68 enrolls full-time in a middle or early college program specifically designed to
1.15allow the student to earn dual high school and college credit. In this case, the student shall
1.16receive developmental college credit and not college credit for completing remedial or
1.17developmental courses. Once a pupil has been enrolled in a postsecondary course under
1.18this section, the pupil shall not be displaced by another student.
1.19EFFECTIVE DATE.This section is effective July 1, 2014.
