1.2relating to human services; modifying chemical use assessment requirements for
1.3civil commitments;amending Minnesota Statutes 2010, section 254A.19, by
1.4adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 254A.19, is amended by adding a
1.7subdivision to read:
1.8 Subd. 4. Civil commitments. A Rule 25 assessment, under Minnesota Rules,
1.9part 9530.6615, does not need to be completed for an individual being committed as a
1.10chemically dependent person, as defined in section 253B.02, and for the duration of a civil
1.11commitment under section 253B.065, 253B.09, or 253B.095 in order for a county to
1.12access consolidated chemical dependency treatment funds under section 254B.04. The
1.13county must determine if the individual meets the financial eligibility requirements for the
1.14consolidated chemical dependency treatment funds under section 254B.04. Nothing in
1.15this subdivision prohibits placement in a treatment facility or treatment program governed
1.16under this chapter or Minnesota Rules, parts 9530.6600 to 9530.6655.
