1.4Statutes 2012, sections 168.185; 168.187, subdivision 12; 168D.07.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 168.185, is amended to read:
1.7168.185 USDOT NUMBERS.
1.8 (a) Except as provided in paragraph (d), an owner of a truck or truck-tractor having
1.9a gross vehicle weight of more than 10,000 pounds, as defined in section169.011,
1.10subdivision 32 , shall report to the commissioner at the time of registration its USDOT
1.11carrier number. A person subject to this paragraph who does not have a USDOT
1.12number shall apply for the number at the time of registration by completing a form
1.13MCS-150 Motor Carrier Identification Report, issued by the Federal Motor Carrier
1.14Safety Administration, or comparable document as determined by the commissioner.
1.15 The commissioner shall maintain a filing schedule for all USDOT number updates that
1.16matches the requirements under Code of Federal Regulations, title 49, section 390.19,
1.17or successor requirements. The commissioner shall not assign a USDOT carrier number
1.18to a vehicle owner who is not subject to this paragraph.
1.19 (b) Assigned USDOT numbers must be displayed as required by section221.031,
1.20subdivision 6 . The vehicle owner shall notify the commissioner if there is a change to the
1.21owner's USDOT number.
1.22 (c) If an owner fails to report or apply for a USDOT number, the commissioner shall
1.23suspend the owner's registration.
2.1 (d) This section does not apply to (1) a farm truck that is not used in interstate
2.2commerce, (2) a vehicle that is not used in intrastate commerce or interstate commerce, or
2.3(3) a vehicle that is owned and used solely in the transaction of official business by the
2.4federal government, the state, or any political subdivision.
2.5 Sec. 2. Minnesota Statutes 2012, section 168.187, subdivision 12, is amended to read:
2.6 Subd. 12. Registration of proratable vehicles.(1) (a) The commissioner of
2.7public safety shall register proratable vehicles of a fleet upon application and payment
2.8of registration fees as provided in subdivision 11. Payment of an additional fee for
2.9each vehicle so registered may be required by the commissioner in an amount not to
2.10exceed $5 per motor powered vehicle, for issuance of a plate, validation sticker, or other
2.11suitable identification for each vehicle. A registration card shall be issued for each vehicle
2.12registered, which shall appropriately identify the vehicle for which it is issued. Such
2.13registration card shall be carried in or upon the vehicle for which it has been issued, at
2.14all times, except that the registration cards for all vehicles in a combination of vehicles
2.15may be carried in or upon the vehicle supplying the motive power. The owner of a vehicle
2.16registered under this section may affix plates or validation stickers to the appropriate
2.17vehicle immediately upon receipt.
2.18(2) (b) Fleet vehicles registered as provided in (1) paragraph (a) shall be deemed
2.19fully registered in this state for any type of movement or operation, except that when a
2.20state grant of authority is required for any movement or operation, no such vehicle shall be
2.21operated in this state unless the owner or operator thereof has been granted authority or
2.22rights therefor by the state and unless said vehicle is being operated in conformity with
2.23such authority or rights. No registration under this section shall excuse the owner or
2.24operator of any vehicle from compliance with the laws of this state, except those requiring
2.25registration and licensing.
2.26 Sec. 3. Minnesota Statutes 2012, section 168D.07, is amended to read:
2.27168D.07 FUEL DECAL FEE.
2.28 (a) The commissioner shall issue a decal or other identification to indicate
2.29compliance with the International Fuel Tax Agreement. A motor carrier may affix a decal
2.30or other identification to the appropriate vehicle immediately upon receipt.
2.31 (b) The commissioner shall collect a fee for the decal or other identification in the
2.32amount established in section168.12, subdivision 5 . Decal or other identification fees
2.33paid to the commissioner under thissubdivision section must be deposited in the vehicle
2.34services operating account in the special revenue fund under section299A.705 .
