1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 3.9223, subdivision 1, is amended to read:
1.7 Subdivision 1. Membership. (a) The state Council on Affairs of Chicano/Latino
1.8People consists of the following members:
1.9(1) 11 members appointed by the governor, including eight members representing
1.10each of the state's congressional districts and three members appointed at large. The
1.11demographic composition of the council members must accurately reflect the demographic
1.12composition of Minnesota's Chicano/Latino community, including migrant workers, as
1.13determined by the state demographer. Membership, terms, compensation, removal of
1.14members, and filling of vacancies are as provided in section15.0575 . Because the council
1.15performs functions that are not purely advisory, the council is not subject to the expiration
1.16date in section15.059 .;
1.17(2) two members of the house of representatives appointed by the speaker and two
1.18members of the senate appointed by the Subcommittee on Committees of the Committee
1.19on Rules and Administration shall serve as nonvoting members of the council.;
1.20(3) other nonvoting members of the council:
1.21(i) a member of the governor's official staff designated by the governor;
1.22(ii) the commissioner of education;
1.23(iii) the commissioner of the Office of Higher Education;
1.24(iv) the commissioner of employment and economic development;
2.1(v) the commissioner of human rights;
2.2(vi) the commissioner of corrections; and
2.3(vii) the chancellor of the Minnesota State Colleges and Universities.
2.4 (b) Each of the commissioners listed in paragraph (a), clause (3), may designate a
2.5staff member to serve on the council instead of the commissioner.
2.6 (c) Only the members designated in paragraph (a), clause (1), are voting members.
2.7 (d) The council shall annually elect from its membership a chair and other officers
2.8it deems necessary.
2.9 Sec. 2. Minnesota Statutes 2012, section 3.9223, subdivision 3, is amended to read:
2.10 Subd. 3. Duties. The council shall:
2.11(1) recommend to the governor and the legislature legislation to improve the
2.12economic and social condition of Chicano/Latino people in this state;
2.13(1) (2) advise the governor and the legislature on the nature of the issues confronting
2.14Chicano/Latino people in this state, including the unique problems encountered by
2.15Chicano/Latino migrant agricultural workers;
2.16(2) (3) advise the governor and the legislature on statutes or rules necessary to ensure
2.17Chicano/Latino people access to benefits and services provided to people in this state;
2.18(3) recommend to the governor and the legislature legislation to improve the
2.19economic and social condition of Chicano/Latino people in this state;
2.20(4) serve as a conduit to state government for organizations of Chicano/Latino
2.21people in the state;
2.22(5) serve as a referral agency to assist Chicano/Latino people to secure access to
2.23state agencies and programs;
2.24(6) serve as a liaison with the federal government, local government units, and
2.25private organizations on matters relating to the Chicano/Latino people of this state;
2.26(7) perform or contract for the performance of studies designed to suggest solutions
2.27to problems of Chicano/Latino people in the areas of education, employment, human
2.28rights, health, housing, social welfare, and other related programs;
2.29(8) implement programs designed to solve problems of Chicano/Latino people when
2.30authorized by other statute, rule, or order;and
2.31(9) publicize the accomplishments of Chicano/Latino people and their contributions
2.32to this state.;
2.33(10) work with other state and federal agencies and organizations to develop small
2.34business opportunities and promote economic development for Latinos in Minnesota;
3.1(11) supervise development of a Latin American trade primer, outlining Latino
3.2customs, cultural traditions, and business practices, including language, for use by
3.3Minnesota's export community;
3.4(12) cooperate with other state and federal agencies and organizations to develop
3.5improved state trade relations with Latin American countries; and
3.6(13) assist recent immigrants in adaptation into the culture and promote the study
3.7of English as a second language.
