1.1A bill for an act
1.2relating to health; preserving the effectiveness of antibiotics used in the treatment
1.3of human and animal diseases; prohibiting the disposal of prescription drugs
1.4containing antibiotics; prohibiting the nontherapeutic use of antibiotics in animal
1.5feed; requiring reports;amending Minnesota Statutes 2010, sections 25.33, by
1.6adding subdivisions; 151.212, by adding a subdivision; proposing coding for new
1.7law in Minnesota Statutes, chapters 25; 115.
1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.9    Section 1. Minnesota Statutes 2010, section 25.33, is amended by adding a subdivision
1.10to read:
1.11    Subd. 8a. Nontherapeutic use. "Nontherapeutic use" means any use of an
1.12antimicrobial drug in animals in the absence of any clinical sign of disease, including use
1.13for growth promotion, feed efficiency, or disease prevention.

1.14    Sec. 2. Minnesota Statutes 2010, section 25.33, is amended by adding a subdivision to
1.15read:
1.16    Subd. 8b. Medically important. "Medically important" means a drug that is
1.17composed wholly or partly of:
1.18(1) any kind of penicillin, tetracycline, macrolide, lincosamide, streptogramin,
1.19aminoglycoside, or sulfonamide; or
1.20(2) any other drug or derivative of a drug that is used in humans or intended for use
1.21in humans to treat or prevent disease or infection caused by microorganisms.

1.22    Sec. 3. [25.385] PROHIBITION ON USE OF MEDICALLY IMPORTANT
1.23ANTIBIOTICS IN ANIMAL FEED.
2.1    (a) After January 1, 2013, a person may not sell, buy, or use animal feed for a
2.2nontherapeutic use that contains medically important antibiotics used in human medicine.
2.3    (b) The commissioner shall, by rule, prohibit the use of any microbial agents for
2.4growth promotion in animals if the agent is used in human therapies or is known to select
2.5for cross-resistance to microbial agents used in human medicine.

2.6    Sec. 4. [115.545] PROHIBITION ON DISPOSAL OF PRESCRIPTION DRUGS.
2.7(a) No person shall dispose of any prescription drug containing antibiotics by
2.8depositing the drug into a wastewater disposal system.
2.9(b) A violation of this section is subject to enforcement under sections 115.071
2.10and 116.072.

2.11    Sec. 5. Minnesota Statutes 2010, section 151.212, is amended by adding a subdivision
2.12to read:
2.13    Subd. 4. Disposal of prescription drugs containing antibiotics. In addition to the
2.14requirements of subdivisions 1 to 3, drugs dispensed containing an antibiotic shall bear
2.15a label affixed to the container in which the drug is dispensed and which is received by
2.16the purchaser stating that it is unlawful to dispose of the drug by depositing it in a sink or
2.17toilet or any other wastewater disposal system.

2.18    Sec. 6. REPORT.
2.19The commissioner of health shall annually report to legislative committees and
2.20divisions with jurisdiction over health on:
2.21    (1) surveillance of antimicrobial-resistant E. coli, campylobacter, and salmonella
2.22in retail meats; and
2.23    (2) monitoring for bacteria, resistant bacteria, and antimicrobial residues in drinking
2.24water supplies, including surface water areas downstream from confined animal feeding
2.25operations.
