1.2relating to human services; providing rate increases for nursing facilities and the
1.3elderly waiver program;amending Minnesota Statutes 2010, section 256B.441,
1.4by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 256B.441, is amended by adding a
1.7subdivision to read:
1.8 Subd. 63. Rate adjustments for October 1, 2012. For the rate year beginning
1.9October 1, 2012, the commissioner shall make available to each nursing facility
1.10reimbursed under this section or any other section operating payment rate adjustments
1.11equal to 2.5 percent of the operating payment rates in effect on September 30, 2012, except
1.12that they shall not increase any performance-based incentive payments under section
1.13256B.434, subdivision 4, paragraph (d), implemented on October 1, 2012, or earlier.
1.14 Sec. 2. RATE ADJUSTMENTS FOR OCTOBER 1, 2012, FOR THE ELDERLY
1.15WAIVER AND ALTERNATIVE CARE PROGRAMS.
1.16Effective October 1, 2012, the elderly waiver and alternative care program service
1.17rates, including all service component rates and limits, shall be increased by 2.5 percent.
1.3elderly waiver program;amending Minnesota Statutes 2010, section 256B.441,
1.4by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 256B.441, is amended by adding a
1.7subdivision to read:
