1.1A bill for an act
1.2relating to education finance; adjusting the special education percentage
1.3eligibility requirement for a charter school to receive the accelerated aid payment
1.4shift;amending Minnesota Statutes 2010, section 127A.45, subdivision 6a.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 127A.45, subdivision 6a, is amended to
1.7read:
1.8    Subd. 6a. Cash flow adjustment. The board of directors of any charter school
1.9serving fewer than 150 students where the percent of students eligible for special education
1.10services equals 100 90 percent of the charter school's total enrollment may request that
1.11the commissioner of education accelerate the school's cash flow under this section. The
1.12commissioner must approve a properly submitted request within 30 days of its receipt.
1.13The commissioner must accelerate the school's cash flow aid payments for all state aid
1.14according to the schedule in the school's request and modify the payments to the school
1.15under subdivision 3 accordingly. The commissioner must delay the special education aid
1.16payments to all other school districts and charter schools in proportion to each district
1.17or charter school's total share of regular special education aid such that the overall aid
1.18payment savings from the aid payment shift remains unchanged for any fiscal year.
1.19EFFECTIVE DATE.This section is effective the day following final enactment.
