1.2relating to capital investment; adding the chairs of the senate's Capital Investment
1.3Committee to those receiving notification regarding capital investment projects;
1.4amending Minnesota Statutes 2012, section 16B.335, subdivisions 1, 2, 5.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 16B.335, subdivision 1, is amended to read:
1.7 Subdivision 1. Construction and major remodeling. (a) The commissioner, or
1.8any other recipient to whom an appropriation is made to acquire or better public lands or
1.9buildings or other public improvements of a capital nature, must not prepare final plans and
1.10specifications for any construction, major remodeling, or land acquisition in anticipation of
1.11which the appropriation was made until the agency that will use the project has presented
1.12the program plan and cost estimates for all elements necessary to complete the project to
1.13the chair of the senate Finance Committee and the chair of the house of representatives
1.14Ways and Means Committee and the chairs have made their recommendations, and
1.15the chair of the senate Capital Investment Committee and the chair of the house of
1.16representatives Capital Investment Committeeis are notified. "Construction or major
1.17remodeling" means construction of a new building, a substantial addition to an existing
1.18building, or a substantial change to the interior configuration of an existing building. The
1.19presentation must note any significant changes in the work that will be done, or in its cost,
1.20since the appropriation for the project was enacted or from the predesign submittal. The
1.21program plans and estimates must be presented for review at least two weeks before a
1.22recommendation is needed. The recommendations are advisory only. Failure or refusal to
1.23make a recommendation is considered a negative recommendation. The chairs of the senate
1.24FinanceCommittee and Capital Investment Committees and the house of representatives
2.1Capital Investment and Ways and Means Committees must also be notified whenever there
2.2is a substantial change in a construction or major remodeling project, or in its cost.
2.3(b) Capital projects exempt from the requirements of this subdivision include
2.4demolition or decommissioning of state assets, hazardous material projects, utility
2.5infrastructure projects, environmental testing, parking lots, parking structures, park
2.6and ride facilities, bus rapid transit stations, light rail lines, exterior lighting, fencing,
2.7highway rest areas, truck stations, storage facilities not consisting primarily of offices or
2.8heated work areas, roads, bridges, trails, pathways, campgrounds, athletic fields, dams,
2.9floodwater retention systems, water access sites, harbors, sewer separation projects, water
2.10and wastewater facilities, port development projects for which the commissioner of
2.11transportation has entered into an assistance agreement under section457A.04 , ice centers,
2.12a local government project with a construction cost of less than $1,500,000, or any other
2.13capital project with a construction cost of less than $750,000.
2.14 Sec. 2. Minnesota Statutes 2012, section 16B.335, subdivision 2, is amended to read:
2.15 Subd. 2. Other projects. All other capital projects for which a specific
2.16appropriation is made must not proceed until the recipient undertaking the project has
2.17notified the chairs of the senate Capital Investment and FinanceCommittee Committees
2.18and the house of representatives Capital Investment and Ways and Means Committees that
2.19the work is ready to begin. Notice is not required for capital projects needed to comply
2.20with the Americans with Disabilities Act, for asset preservation projects to which section
2.2116B.307
applies, or for projects funded by an agency's operating budget or by a capital
2.22asset preservation and replacement account under section16A.632 , or a higher education
2.23asset preservation and replacement account under section135A.046 .
2.24 Sec. 3. Minnesota Statutes 2012, section 16B.335, subdivision 5, is amended to read:
2.25 Subd. 5. Information technology. Agency requests for construction and
2.26remodeling funds shall include money for cost-effective information technology
2.27investments that would enable an agency to reduce its need for office space, provide more
2.28of its services electronically, and decentralize its operations. The Office of Enterprise
2.29Technology must review and approve the information technology portion of construction
2.30and major remodeling program plans before the plans are submitted to the chairs of the
2.31senate Finance Committee and the house of representatives Ways and Means Committee
2.32for their recommendations and the chair of the senate Capital Investment Committee and
2.33the chair of the house of representatives Capital Investment Committeeis are notified as
2.34required by subdivision 1.
