1.1A bill for an act
1.2relating to campaign finance; prohibiting use of public funds to promote or
1.3defeat a ballot question;proposing coding for new law in Minnesota Statutes,
1.4chapters 5; 10A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [5.38] USE OF PUBLIC FINDS; BALLOT QUESTIONS.
1.7Notwithstanding section 10A.52, paragraph (b), the secretary of state shall not
1.8spend, or cause to be spent, any public funds or use any other public resource with
1.9the purpose of promoting or defeating a ballot question at any time. The secretary of
1.10state shall not use the inherent prestige of the office in any manner that has the effect of
1.11promoting or defeating a ballot question. The secretary of state may spend public funds
1.12to provide impartial and balanced information on ballot questions that does not have the
1.13effect of promoting or defeating a ballot question. For purposes of this section, public
1.14funds means all general, special, permanent, trust, and other funds, regardless of source
1.15or purpose, held or administered by a government entity.

1.16    Sec. 2. [10A.52] USE OF PUBLIC FUNDS; BALLOT QUESTIONS.
1.17(a) No public official shall spend, or cause to be spent, any public funds or use any
1.18other public resource with the purpose of promoting or defeating a ballot question or in a
1.19manner that has the effect of promoting or defeating a ballot question.
1.20(b) This prohibition only applies after final enactment of a legislative act that places
1.21a ballot question on the ballot.
2.1(c) For purposes of this section, public funds means all general, special, permanent,
2.2trust, and other funds, regardless of source or purpose, held or administered by a
2.3government entity.
