1.1A bill for an act
1.2relating to education; creating an exemption to the state reciprocity agreement;
1.3amending Minnesota Statutes 2010, section 124D.041, subdivision 3.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 124D.041, subdivision 3, is amended to
1.6read:
1.7    Subd. 3. Procedures. (a) The Department of Education must establish procedures
1.8relating to the application process, the collection or payment of funds under the provisions
1.9of any agreement established pursuant to this section, and the collection of data necessary
1.10to implement any agreement established pursuant to this section.
1.11    (b) Notwithstanding sections 124A.04 and 124A.05, if an agreement is established
1.12between Minnesota and an adjoining state pursuant to this section, the provisions of this
1.13section and the agreement shall apply to all enrollment transfers between Minnesota and
1.14the adjoining state, and provisions of sections 124D.04 and 124D.05 to the contrary,
1.15including provisions relating to tuition payments, shall not apply.
1.16    (c) Notwithstanding paragraph (a), any payments to adjoining states under this
1.17section shall be made according to section 127A.45, subdivision 16.
1.18    (d) Notwithstanding paragraph (b), sections 124D.04, subdivision 6, paragraph (b),
1.19and 124D.05, subdivision 2a, the provisions of this section and the agreement shall not
1.20apply to: (1) enrollment transfers between Minnesota and a school district in an adjoining
1.21state enrolling fewer than 150 pupils that is exempted from participation in the program
1.22under the laws of the adjoining state; or (2) enrollment transfers between Minnesota and a
1.23school district in an adjoining state under a board agreement initiated in fiscal year 2009
1.24to serve students in grade levels discontinued by the resident district; or (3) enrollment
2.1transfers between (i) a Minnesota school district with a total enrollment of fewer than 250
2.2students and a district boundary within five miles of, but not directly bordering, South
2.3Dakota; and (ii) a school district in an adjoining state if the Minnesota school district has
2.4an agreement with one or more school districts in South Dakota.
2.5EFFECTIVE DATE.This section is effective for the 2012-2013 school year and
2.6later.
