1.1A bill for an act
1.2proposing an amendment to the Minnesota Constitution by adding a section to
1.3article IV; requiring a three-fifths vote to enact a law imposing or increasing
1.4certain taxes.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.7An amendment to the Minnesota Constitution is proposed to the people. If the
1.8amendment is adopted, a section shall be added to article IV to read:
1.9Sec. 27. Passage of a law that increases the general rate or expands the taxable
1.10base of a state tax on income or sales or increases property taxes requires the vote of
1.11three-fifths of the members of each house of the legislature. If, however, a single law not
1.12only makes such increases but also makes equal or greater reductions in other taxes so
1.13that the estimated combined revenues raised by state taxes and property taxes in the law
1.14are reduced or maintained, then passage of that law requires only a majority vote of the
1.15members in each house. A law increases property taxes if the law:
1.16(1) increases a property tax rate or levy set or permitted under state law; or
1.17(2) authorizes a governmental unit to impose or increase a property tax rate or levy
1.18without voter approval.
1.19Passage of a law that creates a new tax of statewide applicability also requires the
1.20vote of three-fifths of the members of each house of the legislature.

1.21    Sec. 2. SUBMISSION TO VOTERS.
1.22The proposed amendment must be submitted to the people at the 2012 general
1.23election. The question submitted must be:
2.1"Shall the Minnesota Constitution be amended to require a three-fifths vote of each
2.2house of the legislature to pass a law that increases state income, state sales, or property
2.3taxes?
