1.2relating to state government; making changes to nonvisual technology access
1.3standards;amending Minnesota Statutes 2012, section 16C.145.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2012, section 16C.145, is amended to read:
1.616C.145 NONVISUAL TECHNOLOGY ACCESS STANDARDS.
1.7(a) The commissioner shall develop nonvisual technology access standards. The
1.8standards must be included in all contracts for the procurement of information technology
1.9by, or for the use of, agencies, political subdivisions, and the Minnesota State Colleges and
1.10Universities. The University of Minnesota is encouraged to consider similar standards.
1.11(b) The nonvisual access standards must include the following minimum
1.12specifications:
1.13(1) that effective, interactive control and use of the technology including the
1.14operating system, applications programs, prompts, and format of the data presented, are
1.15readily achievable by nonvisual means;
1.16(2) that the nonvisual access technology must be compatible with information
1.17technology used by other individuals with whom the blind or visually impaired individual
1.18must interact;
1.19(3) that nonvisual access technology must be integrated into networks used to share
1.20communications among employees, program participants, and the public; and
1.21(4) that the nonvisual access technology must have the capability of providing
1.22equivalent access by nonvisual means to telecommunications or other interconnected
1.23network services used by persons who are not blind or visually impaired.
2.1(c) Nothing in this section requires the installation of software or peripheral devices
2.2used for nonvisual access when the information technology is being used by individuals
2.3who are not blind or visually impaired.
2.4(d) Executive branch state agencies subject to section 16E.03, subdivision 9, are not
2.5required to include nonvisual technology access standards developed under this section in
2.6contracts for the procurement of information technology.
