1.2relating to local government; providing and clarifying the compatibility of
1.3concurrently holding certain offices;amending Minnesota Statutes 2012, section
1.4375.09, subdivision 1; proposing coding for new law in Minnesota Statutes,
1.5chapter 123B; repealing Minnesota Statutes 2012, section 367.033.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. [123B.196] COMPATIBILITY OF SCHOOL BOARD OFFICE WITH
1.8OTHER ELECTED OFFICES.
1.9A school board member of a school district, however organized, may serve
1.10concurrently as a member of a city council, a board of county commissioners, or a town
1.11board.
1.12 Sec. 2. Minnesota Statutes 2012, section 375.09, subdivision 1, is amended to read:
1.13 Subdivision 1. No county employment or other elected office; school district
1.14office exception. Except as authorized under section 123B.196 for service on a school board, no county commissioner shall hold another elected office during tenure as
1.16commissioner nor be employed by the county.
1.17 Sec. 3. REPEALER.
1.18Minnesota Statutes 2012, section 367.033, is repealed.
