1.1A bill for an act
1.2relating to human services; modifying commissioner's duties; delaying child care
1.3assistance financial eligibility requirements; amending Minnesota Statutes 2012,
1.4sections 119B.09, subdivision 9a; 256.01, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 119B.09, subdivision 9a, is amended to
1.7read:
1.8    Subd. 9a. Child care centers; assistance. (a) For the purposes of this subdivision,
1.9"qualifying child" means a child who satisfies both of the following:
1.10(1) is not a child or dependent of an employee of the child care provider; and
1.11(2) does not reside with an employee of the child care provider.
1.12(b) Funds distributed under this chapter must not be paid for child care services
1.13that are provided for a child by a child care provider who employs either the parent of
1.14the child or a person who resides with the child, unless at all times at least 50 percent of
1.15the children for whom the child care provider is providing care are qualifying children
1.16under paragraph (a).
1.17(c) If a child care provider satisfies the requirements for payment under paragraph
1.18(b), but the percentage of qualifying children under paragraph (a) for whom the provider
1.19is providing care falls below 50 percent, the provider shall have four weeks to raise the
1.20percentage of qualifying children for whom the provider is providing care to at least 50
1.21percent before payments to the provider are discontinued for child care services provided
1.22for a child who is not a qualifying child.
1.23(d) This subdivision is effective July 1, 2014.

2.1    Sec. 2. Minnesota Statutes 2012, section 256.01, is amended by adding a subdivision
2.2to read:
2.3    Subd. 35. Outreach and training assistance for culturally specific child care
2.4providers. Within available appropriations, the commissioner shall provide technical
2.5assistance, outreach, and training to culturally specific child care providers licensed under
2.6Minnesota Rules, chapter 9502 or 9503, to assist these providers in understanding the
2.7child care licensing requirements under chapter 245A and child care assistance program
2.8requirements under chapter 119B.
