1.3film projects;proposing coding for new law in Minnesota Statutes, chapter 129D.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [129D.20] MINNESOTA FILM PROJECTS REIMBURSEMENT
1.6PROGRAM.
1.7 Subdivision 1. Use of funds. Money appropriated from the Minnesota arts and
1.8cultural heritage fund may be designated to make grants to the Minnesota Film and
1.9TV Board for purposes of this section. Grants under this section must be used for
1.10reimbursements to eligible film projects that promote Minnesota's cultural heritage. The
1.11reimbursements may be used to cover any expenses associated with eligible film projects,
1.12including production and postproduction costs.
1.13 Subd. 2. Eligible film project. (a) To be an eligible film project for purposes of this
1.14section, a film must promote Minnesota's cultural heritage and must be:
1.15(1) written by a current resident of Minnesota and directed or produced by a current
1.16resident of Minnesota;
1.17(2) set in Minnesota and directed or produced by a current resident of Minnesota; or
1.18(3) document an event or period in Minnesota history, whether a true documentary
1.19or fictionalized account of the historic event, and for which either the writer or director of
1.20the film is a current resident of Minnesota.
1.21(b) For purposes of this section, "film" means a short or feature length film or
1.22documentary, whether shot on film, video, or digital media. Film does not include news,
1.23current events, public programming, a program that includes weather or market reports,
1.24a talk show, a production with respect to a questionnaire or contest, a sports event or
2.1sports activity, a gala presentation or awards show, a finished production that solicits
2.2funds, or a production for which the production company is required under United States
2.3Code, title 18, section 2257, to maintain records with respect to a performer portrayed
2.4in a single-media or multimedia program.
2.5 Subd. 3. Production and postproduction requirements. To be eligible for
2.6reimbursement under this section, both production and postproduction of the film must
2.7occur in Minnesota, as determined by criteria developed by the Minnesota Film and
2.8TV Board.
2.9 Subd. 4. Criteria for reimbursement; rule exemption. (a) In determining eligible
2.10film projects for reimbursement under this section, the Minnesota Film and TV Board
2.11shall establish criteria for evaluating a film's promotion of Minnesota's cultural heritage,
2.12standards for selecting recipients of reimbursements, procedures for verifying a film's
2.13compliance with this section, and the application process for reimbursement.
2.14(b) The Minnesota Film and TV Board is not subject to the rulemaking provisions of
2.15chapter 14 in implementing this section, and section 14.386 does not apply.
