1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2010, section 256B.0625, subdivision 48, is amended to
1.8read:
1.9 Subd. 48. Psychiatric consultation to primary care practitioners.Effective
1.10January 1, 2006, Medical assistance covers consultation provided by a psychiatrist or
1.11psychologist via telephone, e-mail, facsimile, or other means of communication to primary
1.12care practitioners, including pediatricians. The need for consultation and the receipt of the
1.13consultation must be documented in the patient record maintained by the primary care
1.14practitioner. If the patient consents, and subject to federal limitations and data privacy
1.15provisions, the consultation may be provided without the patient present.
1.16 Sec. 2. Minnesota Statutes 2010, section 256B.763, is amended to read:
1.17256B.763 CRITICAL ACCESS MENTAL HEALTH RATE INCREASE.
1.18 (a) For services defined in paragraph (b) and rendered on or after July 1, 2007,
1.19payment rates shall be increased by 23.7 percent over the rates in effect on January 1,
1.202006, for:
1.21 (1) psychiatrists and advanced practice registered nurses with a psychiatric specialty;
1.22 (2) community mental health centers under section256B.0625 , subdivision 5; and
2.1 (3) mental health clinics and centers certified under Minnesota Rules, parts
2.29520.0750
to
9520.0870 , or hospital outpatient psychiatric departments that are designated
2.3as essential community providers under section62Q.19 .
2.4 (b) This increase applies to group skills training when provided as a component of
2.5children's therapeutic services and support, psychotherapy, medication management,
2.6evaluation and management, diagnostic assessment, explanation of findings, psychological
2.7testing, neuropsychological services, direction of behavioral aides, and inpatient
2.8consultation.
2.9 (c) This increase does not apply to rates that are governed by section256B.0625 ,
2.10subdivision 30, or256B.761 , paragraph (b), other cost-based rates, rates that are
2.11negotiated with the county, rates that are established by the federal government, or rates
2.12that increased between January 1, 2004, and January 1, 2005.
2.13 (d) The commissioner shall adjust rates paid to prepaid health plans under contract
2.14with the commissioner to reflect the rate increases provided in paragraphs (a), (e), and
2.15(f). The prepaid health plan must pass this rate increase to the providers identified in
2.16paragraphs (a), (e), (f), and (g).
2.17 (e) Payment rates shall be increased by 23.7 percent over the rates in effect on
2.18December 31, 2007, for:
2.19 (1) medication education services provided on or after January 1, 2008, by adult
2.20rehabilitative mental health services providers certified under section256B.0623 ; and
2.21 (2) mental health behavioral aide services provided on or after January 1, 2008, by
2.22children's therapeutic services and support providers certified under section256B.0943 .
2.23 (f) For services defined in paragraph (b) and rendered on or after January 1, 2008, by
2.24children's therapeutic services and support providers certified under section256B.0943
2.25and not already included in paragraph (a), payment rates shall be increased by 23.7 percent
2.26over the rates in effect on December 31, 2007.
2.27 (g) Payment rates shall be increased by 2.3 percent over the rates in effect on
2.28December 31, 2007, for individual and family skills training provided on or after January
2.291, 2008, by children's therapeutic services and support providers certified under section
2.30256B.0943
.
2.31(h) Payment rates for services defined in paragraph (b) and rendered by psychologists
2.32on or after July 1, 2010, shall be increased by 23.7 percent over the rates in effect on
2.33January 1, 2009.

2.31(h) Payment rates for services defined in paragraph (b) and rendered by psychologists
2.32on or after July 1, 2010, shall be increased by 23.7 percent over the rates in effect on
2.33January 1, 2009.
