1.2relating to human rights; ensuring public accommodations for blind and disabled
1.3persons;amending Minnesota Statutes 2012, section 363A.19.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2012, section 363A.19, is amended to read:
1.6363A.19 DISCRIMINATION AGAINST BLIND, DEAF, OR OTHER
1.7PERSONS WITH PHYSICAL OR SENSORY DISABILITIES PROHIBITED.
1.8(a) It is an unfair discriminatory practice for an owner, operator, or manager of a
1.9hotel, restaurant, public conveyance, or other public place to prohibit a blind or deaf
1.10person or a person with a physical or sensory disability from taking a service animal into
1.11the public place or conveyanceif the service animal can be properly identified as being
1.12from a recognized program which trains service animals to aid blind or deaf persons
1.13or persons with physical or sensory disabilities, and if the service animal is properly
1.14harnessed or leashed so that the blind or deaf person or a person with a physical or sensory
1.15disability may maintain control of the service animal.
1.16(b) No person shall require a blind, physically disabled, or deaf person to make an
1.17extra payment or pay an additional charge when taking a service animal into any of the
1.18public places referred to in paragraph (a).
1.19(c) For purposes of this section, "service animal" means a service animal as defined
1.20by the federal Americans with Disabilities Act, as amended.
