1.2relating to state lands; authorizing public sale of certain tax-forfeited land
1.3bordering public water.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
1.6WATER; CARLTON COUNTY.
1.7(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
1.8Carlton County may sell the tax-forfeited lands bordering public water that are described
1.9in paragraph (c), under the remaining provisions of Minnesota Statutes, chapter 282.
1.10(b) The conveyances must be in a form approved by the attorney general. The attorney
1.11general may make changes to the land descriptions to correct errors and ensure accuracy.
1.12(c) The lands to be sold are located in Carlton County and are described as:
1.13(1) Government Lot 1, Section 6, Township 49 North, Range 18 West (parcel ID
1.14number 92-010-0900);
1.15(2) Government Lot 3, Section 6, Township 49 North, Range 18 West (parcel ID
1.16number 92-010-0960);
1.17(3) the Northeast Quarter of the Northwest Quarter or Government Lot 3, Section
1.1831, Township 49 North, Range 18 West (parcel ID number 92-034-5790);
1.19(4) that part of the Northeast Quarter of the Southwest Quarter, Section 3, Township
1.2048 North, Range 21 West, described as: commencing at the northwest corner of the
1.21Northeast Quarter of the Southwest Quarter; thence South 800 feet; thence East 150
1.22feet; thence North 800 feet; thence West 150 feet to the point of beginning, subject to
1.23Highway 210 easement, Section 3, Township 48 North, Range 21 West (parcel ID number
1.2429-140-0240); and
2.1(5) Lots 1 to 4, Block 1, Tamarack Acres, Section 10, Township 48 North, Range 21
2.2West (parcel ID numbers 57-230-0020, 57-230-0040, 57-230-0060, and 57-230-0080).
2.3(d) The county has determined that the county's land management interests would
2.4best be served if the lands were returned to private ownership.
2.5 Sec. 2. FOND DU LAC RESERVATION LANDS.
2.6 If a parcel of land subject to sale under Minnesota Statutes, sections282.01 to
2.7282.13 , includes land within the Fond du Lac Indian reservation, the Carlton County
2.8auditor shall first offer the land to the Fond du Lac band of Chippewa Indians for sale at
2.9the appraised value. The cost of any survey or appraisal must be added to and made a part
2.10of the appraised value. To determine whether the band wants to buy the land, the Carlton
2.11County auditor shall give written notice to the band. If the band wants to buy the land, the
2.12band shall submit a written offer to the Carlton County auditor within two weeks after
2.13receiving the notice. If the offer is for at least the appraised value, the Carlton County
2.14auditor shall accept it.
2.15EFFECTIVE DATE.This section is effective the day after the governing body of
2.16Carlton County and its chief clerical officer timely comply with Minnesota Statutes,
2.17section645.021 .
