1.2relating to state lands; authorizing conveyance of certain surplus state land.
1.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.4 Section 1. CONVEYANCE OF SURPLUS STATE LAND; OLMSTED COUNTY.
1.5(a) Notwithstanding Minnesota Statutes, sections 94.09 to 94.16, the commissioner
1.6of natural resources shall convey to the city of Oronoco for no consideration the surplus
1.7land that is described in paragraph (c).
1.8(b) The conveyance shall occur upon the operation of the reversion clause contained
1.9in the deed for the land described in paragraph (c) in accordance with Minnesota Statutes
1.101965, section 85.188, and after the passage of resolutions by the Olmsted County Board
1.11and the Oronoco City Council, each acknowledging that the requirements set forth in the
1.12Agreement for Transfer of Oronoco Park in the City of Oronoco to the City of Oronoco
1.13by Olmsted County have been sufficiently met to proceed with the conveyance. The
1.14conveyance must be in a form approved by the attorney general, the Olmsted County
1.15Board, and the Oronoco City Council. The conveyance must provide that the land reverts
1.16to the state if the city of Oronoco fails to maintain and operate the land as a public park.
1.17The attorney general may make changes to the land description to correct errors and
1.18ensure accuracy.
1.19(c) The land to be conveyed is located in Olmsted County and is described as:
1.20(1) the East Half of the West Half of the Southeast Quarter of the Southeast Quarter,
1.21Section 7, Township 108 North, Range 14 West, subject to flowage rights in favor of
1.22Olmsted County; and
1.23(2) the East Half of the Southeast Quarter of the Southeast Quarter, Section 7,
1.24Township 108 North, Range 14 West.
2.1(d) The land is currently owned by Olmsted County and used as a public park,
2.2having been conveyed by the state according to Laws 1965, chapter 810, section 9. The
2.31965 law and the corresponding conveyance document require reversion to the state if
2.4the county stops operating the land as a public park. Olmsted County no longer wishes
2.5to operate the public park, but the city of Oronoco has agreed to pay consideration to
2.6Olmsted County to continue the park operation. The commissioner has determined that
2.7the state's land management interests would best be served if, upon the land's reversion to
2.8the state, the land was conveyed to and used by the city of Oronoco as a public park.
