1.1A bill for an act
1.2relating to natural resources; continuing aquatic plant management fees and
1.3priorities;amending Minnesota Statutes 2010, section 103G.615, subdivision 2,
1.4by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 103G.615, subdivision 2, is amended to
1.7read:
1.8    Subd. 2. Fees. (a) The commissioner shall establish a fee schedule for permits to
1.9control or harvest aquatic plants other than wild rice. The fees must be set by rule, and
1.10section 16A.1283 does not apply, but the rule must not take effect until 45 legislative days
1.11after it has been reported to the legislature. The fees in effect as of January 1, 2010,
1.12shall remain in effect until further rulemaking authority is authorized by the legislature.
1.13The fees shall be may not exceed $750 per permit, including groups applying under a
1.14single permit, based upon the cost of receiving, processing, analyzing, and issuing the
1.15permit, and additional costs incurred after the application to inspect and monitor the
1.16activities authorized by the permit, and enforce aquatic plant management rules and
1.17permit requirements.
1.18    (b) A The fee for a permit for the control of rooted aquatic vegetation is $35 for each
1.19contiguous parcel of shoreline owned by an owner may be charged. This fee may not
1.20be charged for permits issued in connection with purple loosestrife control or lakewide
1.21Eurasian water milfoil control programs.
1.22    (c) A fee may not be charged to the state or a federal governmental agency applying
1.23for a permit.
2.1    (d) A fee for a permit for the control of rooted aquatic vegetation in a public
2.2water basin that is 20 acres or less in size shall be one-half of the fee established under
2.3paragraph (a).
2.4(e) The money received for the permits under this subdivision shall be deposited in
2.5the treasury and credited to the water recreation account.

2.6    Sec. 2. Minnesota Statutes 2010, section 103G.615, is amended by adding a
2.7subdivision to read:
2.8    Subd. 8. Aquatic plant management priority. When controlling aquatic plants
2.9on waters of the state, the commissioner shall give priority to waters impaired by aquatic
2.10plants that do not have active lake associations or similar entities working to control
2.11aquatic plants through aquatic plant management permitted under this section.
