1.1A bill for an act
1.2relating to capital improvements; authorizing the sale and issuance of state
1.3bonds; appropriating money for flood hazard mitigation grants.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. FLOOD HAZARD MITIGATION GRANTS; APPROPRIATION.
1.6    Subdivision 1. Appropriation. (a) $55,000,000 is appropriated from the bond
1.7proceeds fund to the commissioner of natural resources for the state share of flood hazard
1.8mitigation grants for publicly owned capital improvements to prevent or alleviate flood
1.9damage under Minnesota Statutes, section 103F.161.
1.10(b) Project priorities shall be determined by the commissioner as appropriate, based
1.11on need.
1.12    (c) This appropriation includes money for the following county and municipal
1.13projects as prioritized by the commissioner: Ada, Afton, Austin, Borup, Breckenridge,
1.14Clay County, Climax, Crookston, Felton, Georgetown, Granite Falls, Halstad, Inver Grove
1.15Heights, Montevideo, Moorhead, Nielsville, Oakport Township, Oslo, Perley, Roseau,
1.16Rushford, and Shelly.
1.17(d) This appropriation includes money for the following Red River watershed
1.18districts: Springbrook, Two Rivers Watershed District; Hay Creek-Norland, Roseau
1.19Watershed District; Brandt-Angus, Middle-Snake-Tamarac Rivers Watershed District;
1.20Grand Marais, Red Lake Watershed District; Red Path, Bois de Sioux Watershed District;
1.21North Ottawa, Bois de Sioux Watershed District; Shelly and Felton, Wild Rice Watershed
1.22District; and Climax and Neilsville, Sand Hill River Watershed District.
2.1    (e) For any project listed in this subdivision that the commissioner determines is not
2.2ready to proceed or does not expend all the money allocated to it, the commissioner may
2.3allocate that project's money to a project on the commissioner's priority list.
2.4    (f) To the extent that the cost of a project exceeds two percent of the median
2.5household income in the municipality multiplied by the number of households in the
2.6municipality, this appropriation is also for the local share of the project.
2.7(g) This appropriation includes money for the following Wild Rice Watershed
2.8District projects:
2.9(1) for property acquisitions originally approved by the Federal Emergency
2.10Management Agency for acquisition cost share and then later denied; and
2.11(2) for river stability acquisitions.
2.12(h) The appropriation for a project funded under paragraph (g), clause (1), is eligible
2.13for up to 100 percent state flood hazard mitigation funding for the acquisition and disposal
2.14of flood-damaged property.
2.15(i) The match required for a project funded under paragraph (g), clause (2), is an
2.16amount equal to 50 percent.
2.17(j) This appropriation includes money for the following Clay County projects:
2.18(1) for property acquisition in Clay County; and
2.19(2) for flood mitigation infrastructure in Clay County to protect the Clay County
2.20government campus.
2.21(k) The match required for a project funded under paragraph (j), clause (1), is an
2.22amount equal to two percent of the median household income in the township multiplied
2.23by the number of households in the township in which the project is located.
2.24(l) The match required for a project funded under paragraph (j), clause (2), is an
2.25amount equal to 12.5 percent of the cost of the project.
2.26    Subd. 2. Bond sale. To provide the money appropriated in this section from the
2.27bond proceeds fund, the commissioner of management and budget shall sell and issue
2.28bonds of the state in an amount up to $55,000,000 in the manner, upon the terms, and with
2.29the effect prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the
2.30Minnesota Constitution, article XI, sections 4 to 7.
2.31EFFECTIVE DATE.This section is effective the day following final enactment.
