1.14BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.16 The sums shown in the column under "Appropriations" are appropriated from the
1.17bond proceeds fund, or another named fund, to the state agencies or officials indicated,
1.18to be spent for public purposes. Appropriations of bond proceeds must be spent as
1.19authorized by the Minnesota Constitution, article XI, section 5, paragraph (a), to acquire
1.20and better public land and buildings and other public improvements of a capital nature, or
1.21as authorized by the Minnesota Constitution, article XI, section 5, paragraphs (b) to (j),
1.22or article XIV. Unless otherwise specified, money appropriated in this act for a capital
1.23program or project may be used to pay state agency staff costs that are attributed directly
1.24to the capital program or project in accordance with accounting policies adopted by the
1.25commissioner of management and budget. Unless otherwise specified, the appropriations
1.26in this act are available until the project is completed or abandoned subject to Minnesota
1.27Statutes, section 16A.642.
2.11To the commissioner of natural resources for
2.12the purposes specified in this section.
2.13The appropriations in this section are
2.14subject to the requirements of the natural
2.15resources capital improvement program
2.16under Minnesota Statutes, section 86A.12,
2.17unless this section or the statutes referred
2.18to in this section provide more specific
2.19standards, criteria, or priorities for projects
2.20than Minnesota Statutes, section 86A.12.
2.22(a) For the state share of flood hazard
2.23mitigation grants for publicly owned capital
2.24improvements to prevent or alleviate
2.25flood damage under Minnesota Statutes,
2.26section 103F.161. Project priorities shall
2.27be determined by the commissioner as
2.28appropriate, based on need.
2.29(b) To the extent that the cost of a project
2.30exceeds two percent of the median household
2.31income in the municipality or unit of
2.32government on the commissioner's priority
2.33list multiplied by the number of households
2.34in the municipality or unit of government
3.1on the commissioner's priority list, this
3.2appropriation is also for the local share of the
3.3project.
3.4(c) Up to $6,000,000 of this appropriation is
3.5for the project in the city of Roseau.
3.6(d) Up to $3,000,000 of this appropriation is
3.7for the project in the city of Georgetown.
3.8(e) Up to $16,500,000 of this appropriation
3.9is for the project in the city of Moorhead.
3.11To the commissioner of management
3.12and budget for bond sale expenses under
3.13Minnesota Statutes, section 16A.641,
3.14subdivision 8.
3.15 Sec. 4. BOND SALE SCHEDULE.
3.16 The commissioner of management and budget shall schedule the sale of state
3.17general obligation bonds so that, during the biennium ending June 30, 2013, no more
3.18than $1,175,188,000 will need to be transferred from the general fund to the state bond
3.19fund to pay principal and interest due and to become due on outstanding state general
3.20obligation bonds. During the biennium, before each sale of state general obligation bonds,
3.21the commissioner of management and budget shall calculate the amount of debt service
3.22payments needed on bonds previously issued and shall estimate the amount of debt service
3.23payments that will be needed on the bonds scheduled to be sold. The commissioner shall
3.24adjust the amount of bonds scheduled to be sold so as to remain within the limit set by this
3.25section. The amount needed to make the debt service payments is appropriated from the
3.26general fund as provided in Minnesota Statutes, section 16A.641.
3.27 Sec. 5. BOND SALE AUTHORIZATION.
3.28 To provide the money appropriated in this act from the bond proceeds fund, the
3.29commissioner of management and budget shall sell and issue bonds of the state in an
3.30amount up to $45,045,000 in the manner, upon the terms, and with the effect prescribed by
3.31Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota Constitution,
3.32article XI, sections 4 to 7.
4.1 Sec. 6. APPROPRIATION; FEDERAL MATCH.
4.2$5,000,000 is appropriated from the general fund to the commissioner of public
4.3safety to provide a match for Federal Emergency Management Agency (FEMA) disaster
4.4assistance to state agencies and political subdivisions under Minnesota Statutes, section
4.512.221, in the area designated under Presidential Declaration of Major Disaster DR-1982,
4.6for the flooding in Minnesota in the spring of 2011, whether included in the original
4.7declaration or added later by federal government action. This is a onetime appropriation.
4.8This appropriation does not lapse.
4.9 Sec. 7. 2008, 2010 BOND SALE AUTHORIZATIONS REDUCED.
4.10 (a) The bond sale authorization in Laws 2008, chapter 179, section 27, subdivision
4.111, is reduced by $3,000,000.
4.12 (b) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.131, is reduced by $354,380,000.
4.14 (c) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.152, is reduced by $5,780,000.
4.16 (d) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.174, is reduced by $6,500,000.
4.18 Sec. 8. Minnesota Statutes 2010, section 16A.641, subdivision 4a, is amended to read:
4.19 Subd. 4a. Negotiated sales; temporary authority. Notwithstanding the public
4.20sale requirements of subdivision 4 and section16A.66, subdivision 2 , from June 1,
4.212009, until June 30, 2011, the commissioner may sell bonds, including refunding bonds,
4.22at negotiated sale.
4.23 Sec. 9. Minnesota Statutes 2010, section 16A.641, subdivision 7, is amended to read:
4.24 Subd. 7. Credit of proceeds. (a) Proceeds of bonds issued under each law must be
4.25credited by the commissioner to a special fund, as provided in this subdivision.
4.26(b) Accrued interestand any premium received on sale of the bonds must be credited
4.27to the state bond fund created by the Constitution, article XI, section 7. Any premium
4.28received on the sale of the bonds on or prior to December 1, 2012, must be credited to
4.29the state bond fund. Any premium received on the sale of the bonds after December 1,
4.302012, must be credited to either the bond proceeds fund where it is used to reduce the par
4.31amount of the bonds issued or the state bond fund.
5.1(c) Except as otherwise provided by law, proceeds of state bonds issued under the
5.2Constitution, article XI, section 5, clause (a), must be credited to the bond proceeds fund
5.3established by section16A.631 .
5.4(d) Proceeds of state highway bonds must be credited to the trunk highway fund
5.5under the Constitution, article XIV, section 6.
5.6(e) Proceeds of bonds issued for programs of grants or loans to political subdivisions
5.7must be credited to special accounts in the bond proceeds fund or to special funds
5.8established by laws stating the purposes of the grants or loans, and the standards and
5.9criteria under which an executive agency is authorized to make them.
5.10(f) Proceeds of refunding bonds must be credited to the state bond fund as provided
5.11in section16A.66, subdivision 1 .
5.12(g) Proceeds of other bonds must be credited as provided in the law authorizing
5.13their issuance.
5.14 Sec. 10. Minnesota Statutes 2010, section 16A.642, subdivision 2, is amended to read:
5.15 Subd. 2. Cancellation. (a) If the commissioner determines that the purposes for
5.16which general obligation bonds of the state have been issued or for which general fund
5.17monies were appropriated are accomplished or abandoned, after consultation with the
5.18affected agencies, and there is a remaining authorization or appropriation for a specific
5.19project of $500 or less, the commissioner may cancel the remaining authorization or
5.20appropriation for that project.
5.21(b) If a premium received on the sale of bonds is credited to the bond proceeds
5.22fund, pursuant to section 16A.641, subdivision 7, paragraph (b), the corresponding bond
5.23authorization to which the premium is attributable must be reduced accordingly by the
5.24commissioner.
5.25(c) The commissioner must notify the chairs of the senate Finance Committee and
5.26the house of representatives Capital Investment Committee of any bond authorizations or
5.27general fund appropriations canceled under this subdivision.
5.28 Sec. 11. Laws 2006, chapter 258, section 7, subdivision 3, as amended by Laws 2007,
5.29chapter 122, section 4, and Laws 2008, chapter 179, section 59, is amended to read:
5.31For the state share of flood hazard
5.32mitigation grants for publicly owned capital
5.33improvements to prevent or alleviate flood
6.1damage under Minnesota Statutes, section
6.2103F.161.
6.3The commissioner shall determine project
6.4priorities as appropriate, based on need.
6.5This appropriation includes money for the
6.6following projects:
6.7(a) Austin
6.8(b) Albert Lea
6.9(c) Browns Valley
6.10(d) Crookston
6.11(e) Canisteo Mine
6.12(f) Delano
6.13(g) East Grand Forks
6.14(h) Golden Valley
6.15(i) Grand Marais Creek
6.16(j) Granite Falls
6.17(k) Inver Grove Heights
6.18(l) Manston Slough
6.19(m) Oakport Township
6.20(n) Riverton Township
6.21(o) Roseau
6.22(p) Shell Rock Watershed District
6.23(q) St. Vincent
6.24(r) Wild Rice River Watershed District
6.25For any project listed in this subdivision
6.26that the commissioner determines is not
6.27ready to proceed or does not expend all the
6.28money allocated to it, the commissioner may
6.29allocate that project's money to a project on
6.30the commissioner's priority list.
7.1To the extent that the cost of a project in Ada,
7.2Breckenridge, Browns Valley, Crookston,
7.3Dawson, East Grand Forks, Granite Falls,
7.4Montevideo, Oakport Township, Roseau,
7.5St. Vincent, or Warren exceeds two percent
7.6of the median household income in the
7.7municipality multiplied by the number
7.8of households in the municipality, this
7.9appropriation is also for the local share of the
7.10project. The local share for the St. Vincent
7.11dike may not exceed $30,000.
7.12Notwithstanding Minnesota Statutes,
7.13section 16A.642, the bond authorization
7.14and appropriation of bond proceeds in this
7.15subdivision are available until June 30, 2014.
7.16 Sec. 12. Laws 2006, chapter 258, section 7, subdivision 23, as amended by Laws 2010,
7.17chapter 399, section 2, is amended to read:
7.19For matching grants under Minnesota
7.20Statutes, section85.019, subdivision 4c .
7.21$500,000 is for a grant to Carlton County
7.22to predesign, design, and construct a
7.23nonmotorized pedestrian trail connection
7.24to the Willard Munger State Trail from the
7.25city of Carlton through the city of Scanlon
7.26continuing to the city of Cloquet, along the
7.27St. Louis River in Carlton County.
7.28$260,000 is to provide the state match for the
7.29cost of the Soo Line Multiuse Recreational
7.30Bridge project over marked Trunk Highway
7.31169 in Mille Lacs County.
7.32$175,000 is for a grant to the city of Bowlus
7.33in Morrison County to design, construct,
8.1furnish, and equip a trailhead center at the
8.2head of the Soo Line Recreational Trail.
8.3$125,000 is for a grant to Morrison
8.4County to predesign, design, construct,
8.5furnish, and equip a park-and-ride lot and
8.6restroom building adjacent to the Soo Line
8.7Recreational Trail at U.S. Highway 10.
8.8$950,000 is for a grant to the St. Louis
8.9and Lake Counties Regional Railroad
8.10Authority for land acquisition, engineering,
8.11construction, furnishing, and equipping of
8.12all or part of a 19-mile "Boundary Waters
8.13Connection" of the Mesabi Trail from
8.14Bearhead Lake Vermilion State Park to
8.15the International Wolf Center in Ely.This
8.16appropriation is contingent upon a matching
8.17contribution of $950,000 from other
8.18sources, public or private. Notwithstanding
8.19Minnesota Statutes, section16A.642 , the
8.20bond authorization and appropriation of bond
8.21proceeds for this project are available until
8.22June 30, 2014.
8.23 Sec. 13. Laws 2006, chapter 258, section 17, subdivision 8, as amended by Laws 2008,
8.24chapter 179, section 64, and Laws 2008, chapter 365, section 4, is amended to read:
8.27For the cost of improvements and betterments
8.28of a capital nature and acquisition by the
8.29council and local government units of
8.30regional recreational open-space lands in
8.31accordance with the council's policy plan
8.32as provided in Minnesota Statutes, section
8.33473.147
. Priority must be given to park
8.34rehabilitation and land acquisition projects.
9.1$300,000 is for a grant to the city of
9.2Bloomingtonto renovate for environmental
9.3analysis and review, design, and construction
9.4of an earthen berm and a multimodal trail
9.5connection across Long Meadow Lake in
9.6the vicinity of the old Cedar Avenue bridge
9.7 and for development of a segment of the
9.8Minnesota Valley State Trail from Fort
9.9Snelling State Park to the Long Meadow
9.10Lake crossing to serve as a hiking and
9.11bicycling trail connection.
9.12$6,000,000 is for a grant to the county
9.13of Dakota to acquire land for a regional
9.14park and wildlife area adjacent to the
9.15Vermillion Highlands Research, Recreation,
9.16and Wildlife Management Area in Dakota
9.17County.
9.18$1,800,000 is for a grant to the city of
9.19Minneapolis to complete land acquisition for
9.20and construction of the Cedar Lake Trail.
9.21$3,500,000 is for a grant to the Minneapolis
9.22Park and Recreation Board to design,
9.23construct, furnish, and equip a new cultural
9.24and community center in the East Phillips
9.25neighborhood in Minneapolis.
9.26$250,000 is for a grant to the Minneapolis
9.27Park and Recreation Board to predesign
9.28completion of the Grand Rounds National
9.29Scenic Byway by providing a link between
9.30northeast Minneapolis on Stinson Avenue
9.31and Southeast Minneapolis at East River
9.32Road.
9.33$2,500,000 is for a grant to the Minneapolis
9.34Park and Recreation Board to mitigate
9.35flooding at Lake of the Isles in the city
10.1of Minneapolis. The grant must be used
10.2for shoreline stabilization and restoration,
10.3dredging, wetland replacement, and other
10.4infrastructure improvements necessary to
10.5deal with the 1997 flood damage and to
10.6prevent future flooding.
10.7$321,000 is for a grant to Ramsey County
10.8to construct a bicycle and pedestrian trail on
10.9the north side of Lower Afton Road between
10.10Century Avenue and McKnight Road in the
10.11city of Maplewood. This appropriation is
10.12not available until the commissioner has
10.13determined that at least an equal amount has
10.14been committed from nonstate sources.
10.15$9,000,000 is for a grant to the city of St.
10.16Paul to predesign, design, construct, furnish,
10.17equip, and redevelop infrastructure at the
10.18Como Zoo.
10.19$2,500,000 is for a grant to the city of St.
10.20Paul to acquire land for and to predesign,
10.21design, construct, furnish, and equip river
10.22park development and redevelopment
10.23infrastructure in National Great River Park
10.24along the Mississippi River in St. Paul.
10.25$2,000,000 is for a grant to the city of
10.26South St. Paul for the closure, capping, and
10.27remediation of approximately 80 acres of
10.28the Port Crosby construction and demolition
10.29debris landfill in South St. Paul, as the fifth
10.30phase of converting the land into parkland,
10.31and to restore approximately 80 acres of
10.32riverfront land along the Mississippi River.
10.33$191,000 is for a grant to the city of White
10.34Bear Lake to construct the Lake Avenue
11.1Regional Trail connecting Highway 96
11.2Regional Trail with Ramsey Beach.
11.3 Sec. 14. Laws 2008, chapter 179, section 15, subdivision 8, is amended to read:
11.6Notwithstanding any law to the contrary, for
11.7a grant to Olmsted County to acquire land for,
11.8and to design, construct, furnish, and equip
11.9the Southeastern Minnesota Regional Public
11.10Safety Training Center in Olmsted County.
11.11The facility must include, but is not limited
11.12to, a live burn training simulator, a driving
11.13range, and a weapons training facility.
11.14This appropriation or any portion of it isnot
11.15availableuntil when the commissioner has
11.16determined thatat least an equal amount
11.17has been committed it has been matched,
11.18dollar-for-dollar, from nonstate sources.
11.19EFFECTIVE DATE.This section is effective retroactively from December 27,
11.202007.
11.21 Sec. 15. Laws 2008, chapter 179, section 18, subdivision 3, is amended to read:
11.24To demolish surplus, nonfunctional, or
11.25deteriorated facilities and infrastructure
11.26or to renovate surplus, nonfunctional, or
11.27deteriorated facilities and infrastructure
11.28at Department of Human Services
11.29campuses. These projects must facilitate the
11.30redevelopment or reuse of these campuses
11.31consistent with redevelopment plan concepts
11.32developed and approved under Laws 2003,
11.33First Special Session chapter 14, article
12.16, section 64, subdivision 2. If a surplus
12.2campus is sold or transferred to a local unit
12.3of government, unspent portions of this
12.4appropriation may be granted to that local
12.5unit of government for the purposes stated in
12.6this subdivision.
12.7Up to$400,000 $125,000 is for preparation
12.8and site development, including demolition
12.9of buildings and infrastructure, to implement
12.10the redevelopment and reuse of the Ah Gwah
12.11Ching Regional Treatment Center. This
12.12amount may be granted to Cass County for
12.13the purposes stated in this subdivision. If
12.14the campus is sold or transferred by Cass
12.15County toa local unit of government the
12.16city of Walker, unspent portions of this
12.17appropriation may be granted tothat local
12.18unit of government the city of Walker for the
12.19purposes stated in this subdivision.
12.20 Sec. 16. Laws 2008, chapter 179, section 18, subdivision 6, as amended by Laws 2010,
12.21chapter 399, section 5, is amended to read:
12.23For a grant to Hennepin County to predesign,
12.24design, construct, furnish, and equipan
12.25outpatient clinic and a health education
12.26facility at Hennepin County Medical
12.27Centerthat includes teaching clinics and an
12.28education center.
12.29 Sec. 17. Laws 2008, chapter 179, section 19, subdivision 4, is amended to read:
13.1To replace the sections of the campus-wide
13.2heating, ventilation, and air conditioning
13.3system that serve Building 17. To predesign,
13.4design, and construct improvements to
13.5heating, ventilation, air conditioning, and
13.6lighting systems and associated areas serving
13.7the south wing of Building 17.
13.8 Sec. 18. Laws 2008, chapter 179, section 24, subdivision 4, is amended to read:
13.11To be allocated to county and local
13.12jurisdictions as matching money for historic
13.13preservation projects of a capital nature,
13.14as provided in new Minnesota Statutes,
13.15section138.0525 . This appropriation
13.16includes money for grants to the city of
13.17Hokah to renovate the Hokah City Hall
13.18building; and the Houston County Historical
13.19Society to renovate existing space and to
13.20predesign, design, and construct an addition
13.21to the Houston County Historical Society
13.22building located in the city of Caledonia.
13.23Notwithstanding Minnesota Statutes, section
13.24138.0525, the city of Hokah is not required
13.25to provide a match.
13.26$100,000 is for a grant to the city of Wells to
13.27renovate the historic Wells Train Depot. No
13.28match is required for this grant.
13.29 Sec. 19. Laws 2008, chapter 365, section 4, subdivision 3, as amended by Laws
13.302010, chapter 189, section 16, subdivision 4, and Laws 2010, chapter 189, section 58,
13.31is amended to read:
14.1For a grant to the city of Bloomington to
14.2renovate for environmental analysis and
14.3review, design, and construction of an earthen
14.4berm and a multimodal trail connection
14.5across Long Meadow Lake in the vicinity
14.6of the old Cedar Avenue bridge and for
14.7development of a segment of the Minnesota
14.8Valley State Trail from Fort Snelling State
14.9Park to the Long Meadow Lake crossing
14.10for bicycle commuters and recreational
14.11users. This appropriation is added to the
14.12appropriation in Laws 2006, chapter 258,
14.13section 17, subdivision 8.
14.14 Sec. 20. Laws 2009, chapter 93, article 1, section 14, subdivision 3, is amended to read:
14.16Of this amount, up to $500,000 is
14.17to acquire land located inRedwood
14.18County southeastern, southwestern, and
14.19northeastern Minnesota for publicly owned
14.20veterans cemeteries, to be operated by
14.21the commissioner of veterans affairs. The
14.22commissioner also must seek donations of
14.23land for the cemeteries. The balance of the
14.24appropriation is to predesign and design
14.25the cemeteries. Federal reimbursement of
14.26design costs for each cemetery must be
14.27deposited in the state treasury and credited to
14.28a special account and is appropriated to the
14.29commissioner of veterans affairs to design the
14.30remaining cemeteries. Following completion
14.31of all legislatively authorized Minnesota
14.32state veterans cemeteries, final federal
14.33reimbursement of predesign and design costs
14.34is appropriated to the commissioner for asset
14.35preservation of veterans homes statewide,
15.1to be spent in accordance with Minnesota
15.2Statutes, section16B.307 .
15.3 Sec. 21. Laws 2009, chapter 93, article 1, section 22, the effective date, is amended to
15.4read:
15.5EFFECTIVE DATE.This section is effective the day following final enactment
15.6and expires July 1, 2011.
15.7 Sec. 22. Laws 2010, chapter 189, section 6, subdivision 2, is amended to read:
15.9To demolish the Alpha Building.
15.10 Sec. 23. Laws 2010, chapter 189, section 6, subdivision 4, is amended to read:
15.12To design, construct, and equip a storage
15.13and maintenance building on the site of the
15.14demolished Alpha Building.
15.15 Sec. 24. Laws 2010, chapter 189, section 7, subdivision 22, is amended to read:
15.17For a grant to Hennepin County to conduct
15.18emergency building stabilization at Fort
15.19Snelling Upper Bluff. This appropriation
15.20may also be used for all work necessary to
15.21rehabilitate buildings and sites for occupancy
15.22and use. This appropriation is not available
15.23until the commissioner of management and
15.24budget has determined that Hennepin County
15.25has entered into appropriate agreements to
15.26use Sentence to Serve labor for the project
15.27that will train the Sentence to Serve laborers
15.28in the skills needed for the work.
15.29 Sec. 25. Laws 2010, chapter 189, section 14, subdivision 3, is amended to read:
16.2To the commissioner of administration to
16.3predesign and design a new state emergency
16.4operations center in Arden Hills.
16.5The commissioner of administration must
16.6consult with the commissioner of public
16.7safety in the predesign and design. This
16.8appropriation is not available until the
16.9commissioner has reported to the chairs and
16.10ranking minority members of the house of
16.11representatives and senate committees with
16.12jurisdiction over public safety policy and
16.13finance, capital investment, finance, and
16.14ways and means, how the Arden Hills site
16.15will be adequately accessible in the event
16.16of a disaster that adversely affects major
16.17transportation corridors.
16.18Notwithstanding Minnesota Statutes, section
16.1916B.31, subdivision 5, the commissioner
16.20of administration, at the request of the
16.21commissioner of public safety, may acquire
16.22land, utility and road easements, and any
16.23other necessary right of access or use from
16.24the federal government or other applicable
16.25parties for the state emergency operations
16.26center proposed to be located in Arden Hills.
16.27 Sec. 26. Laws 2010, chapter 189, section 16, subdivision 4, is amended to read:
16.31For the cost of improvements and betterments
16.32of a capital nature and acquisition by the
16.33council and local government units of
16.34regional recreational open-space lands in
17.1accordance with the council's policy plan
17.2as provided in Minnesota Statutes, section
17.3473.147
. Priority must be given to park
17.4rehabilitation and land acquisition projects.
17.5This appropriation must not be used to
17.6purchase easements.

19.1 Sec. 23. PLANNING NEW VETERANS CEMETERIES.
19.2(a) The commissioner of veterans affairs shall determine a suitable site and plan for
19.3three new state veterans cemeteries, one to be located in northeastern Minnesota, one to
19.4be located in southeastern Minnesota, and one to be located in southwestern Minnesota.
19.5In determining the site for a cemetery, the commissioner shall consider available public
19.6land options and shall seek proposals for donated land from interested counties, local
19.7communities, civic organizations, veterans service organizations, and individuals.
19.8(b) For determining the veterans cemetery site in southeastern Minnesota, the
19.9commissioner shall give priority consideration to land owned and proposed for donation
19.10by the county of Fillmore.
19.11(c) The commissioner's planning process for a state veterans cemetery must include,
19.12at a minimum, the following actions:
19.13(1) determining the need for the cemetery;
19.14(2) investigating the availability of suitable land for the cemetery;
19.15(3) assessment of impacts of the cemetery;
19.16(4) encouragement of support from veteran service organizations and local
19.17governments; and
19.18(5) preparation and submission of a preapplication for a grant from the United States
19.19Department of Veterans Affairs for commitment of funding for establishing the cemetery.
19.20(d) By January 15, 2011, the commissioner shall report to the chair and ranking
19.21minority member of the house of representatives and senate committees having
19.22responsibility for veterans affairs with a report of the commissioner's progress in
19.23implementing this section.
19.24 Sec. 29. Laws 2010, Second Special Session chapter 1, article 1, section 9, subdivision

3.15 Sec. 4. BOND SALE SCHEDULE.
3.16 The commissioner of management and budget shall schedule the sale of state
3.17general obligation bonds so that, during the biennium ending June 30, 2013, no more
3.18than $1,175,188,000 will need to be transferred from the general fund to the state bond
3.19fund to pay principal and interest due and to become due on outstanding state general
3.20obligation bonds. During the biennium, before each sale of state general obligation bonds,
3.21the commissioner of management and budget shall calculate the amount of debt service
3.22payments needed on bonds previously issued and shall estimate the amount of debt service
3.23payments that will be needed on the bonds scheduled to be sold. The commissioner shall
3.24adjust the amount of bonds scheduled to be sold so as to remain within the limit set by this
3.25section. The amount needed to make the debt service payments is appropriated from the
3.26general fund as provided in Minnesota Statutes, section 16A.641.
3.27 Sec. 5. BOND SALE AUTHORIZATION.
3.28 To provide the money appropriated in this act from the bond proceeds fund, the
3.29commissioner of management and budget shall sell and issue bonds of the state in an
3.30amount up to $45,045,000 in the manner, upon the terms, and with the effect prescribed by
3.31Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota Constitution,
3.32article XI, sections 4 to 7.
4.1 Sec. 6. APPROPRIATION; FEDERAL MATCH.
4.2$5,000,000 is appropriated from the general fund to the commissioner of public
4.3safety to provide a match for Federal Emergency Management Agency (FEMA) disaster
4.4assistance to state agencies and political subdivisions under Minnesota Statutes, section
4.512.221, in the area designated under Presidential Declaration of Major Disaster DR-1982,
4.6for the flooding in Minnesota in the spring of 2011, whether included in the original
4.7declaration or added later by federal government action. This is a onetime appropriation.
4.8This appropriation does not lapse.
4.9 Sec. 7. 2008, 2010 BOND SALE AUTHORIZATIONS REDUCED.
4.10 (a) The bond sale authorization in Laws 2008, chapter 179, section 27, subdivision
4.111, is reduced by $3,000,000.
4.12 (b) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.131, is reduced by $354,380,000.
4.14 (c) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.152, is reduced by $5,780,000.
4.16 (d) The bond sale authorization in Laws 2010, chapter 189, section 26, subdivision
4.174, is reduced by $6,500,000.
4.18 Sec. 8. Minnesota Statutes 2010, section 16A.641, subdivision 4a, is amended to read:

4.24 Subd. 7. Credit of proceeds. (a) Proceeds of bonds issued under each law must be
4.25credited by the commissioner to a special fund, as provided in this subdivision.
4.26(b) Accrued interest
4.27to the state bond fund created by the Constitution, article XI, section 7. Any premium
4.28received on the sale of the bonds on or prior to December 1, 2012, must be credited to
4.29the state bond fund. Any premium received on the sale of the bonds after December 1,
4.302012, must be credited to either the bond proceeds fund where it is used to reduce the par
4.31amount of the bonds issued or the state bond fund.
5.1(c) Except as otherwise provided by law, proceeds of state bonds issued under the
5.2Constitution, article XI, section 5, clause (a), must be credited to the bond proceeds fund
5.3established by section
5.4(d) Proceeds of state highway bonds must be credited to the trunk highway fund
5.5under the Constitution, article XIV, section 6.
5.6(e) Proceeds of bonds issued for programs of grants or loans to political subdivisions
5.7must be credited to special accounts in the bond proceeds fund or to special funds
5.8established by laws stating the purposes of the grants or loans, and the standards and
5.9criteria under which an executive agency is authorized to make them.
5.10(f) Proceeds of refunding bonds must be credited to the state bond fund as provided
5.11in section
5.12(g) Proceeds of other bonds must be credited as provided in the law authorizing
5.13their issuance.
5.14 Sec. 10. Minnesota Statutes 2010, section 16A.642, subdivision 2, is amended to read:
5.15 Subd. 2. Cancellation. (a) If the commissioner determines that the purposes for
5.16which general obligation bonds of the state have been issued or for which general fund
5.17monies were appropriated are accomplished or abandoned, after consultation with the
5.18affected agencies, and there is a remaining authorization or appropriation for a specific
5.19project of $500 or less, the commissioner may cancel the remaining authorization or
5.20appropriation for that project.
5.21(b) If a premium received on the sale of bonds is credited to the bond proceeds
5.22fund, pursuant to section 16A.641, subdivision 7, paragraph (b), the corresponding bond
5.23authorization to which the premium is attributable must be reduced accordingly by the
5.24commissioner.
5.25(c) The commissioner must notify the chairs of the senate Finance Committee and
5.26the house of representatives Capital Investment Committee of any bond authorizations or
5.27general fund appropriations canceled under this subdivision.

18.33 Sec. 28. Laws 2010, chapter 333, article 2, section 23, is amended to read:
19.1 Sec. 23. PLANNING NEW VETERANS CEMETERIES.
19.2(a) The commissioner of veterans affairs shall determine a suitable site and plan for
19.3three new state veterans cemeteries, one to be located in northeastern Minnesota, one to
19.4be located in southeastern Minnesota, and one to be located in southwestern Minnesota.
19.5In determining the site for a cemetery, the commissioner shall consider available public
19.6land options and shall seek proposals for donated land from interested counties, local
19.7communities, civic organizations, veterans service organizations, and individuals.
19.8(b) For determining the veterans cemetery site in southeastern Minnesota, the
19.9commissioner shall give priority consideration to land owned and proposed for donation
19.10by the county of Fillmore.
19.11(c) The commissioner's planning process for a state veterans cemetery must include,
19.12at a minimum, the following actions:
19.13(1) determining the need for the cemetery;
19.14(2) investigating the availability of suitable land for the cemetery;
19.15(3) assessment of impacts of the cemetery;
19.16(4) encouragement of support from veteran service organizations and local
19.17governments; and
19.18(5) preparation and submission of a preapplication for a grant from the United States
19.19Department of Veterans Affairs for commitment of funding for establishing the cemetery.
19.20(d) By January 15, 2011, the commissioner shall report to the chair and ranking
19.21minority member of the house of representatives and senate committees having
19.22responsibility for veterans affairs with a report of the commissioner's progress in
19.23implementing this section.
