1.3Minnesota Statutes 2010, section 122A.414, subdivisions 1a, 2, 2a, 2b.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 122A.414, subdivision 1a, is amended to
1.6read:
1.7 Subd. 1a. Transitional planning year.(a) To be eligible to participate in an
1.8alternative teacher professional pay system, a school district, intermediate school district,
1.9or site, at least one school year before it expects to fully implement an alternative pay
1.10system, must:
1.11(1) submit to the department a letter of intent executed by the school district or
1.12intermediate school district and the exclusive representative of the teachers to complete
1.13a plan preparing for full implementation, begin the process of developing an alternative
1.14teacher pay plan, consistent with subdivision 2, that may include, among other activities,
1.15training to evaluate teacher performance, a restructured school day to develop integrated
1.16ongoing site-based professional development activities, release time to develop an
1.17alternative pay system agreement, and teacher and staff training on using multiple data
1.18sources; and.
1.19(2) agree to use up to two percent of basic revenue for staff development purposes,
1.20consistent with sections
122A.60 and
122A.61, to develop the alternative teacher
1.21professional pay system agreement under this section.
1.22(b) To be eligible to participate in an alternative teacher professional pay system, a
1.23charter school, at least one school year before it expects to fully implement an alternative
1.24pay system, must:
2.1(1) submit to the department a letter of intent executed by the charter school and the
2.2charter school board of directors;
2.3(2) submit the record of a formal vote by the teachers employed at the charter
2.4school indicating at least 70 percent of all teachers agree to implement the alternative
2.5pay system; and
2.6(3) agree to use up to two percent of basic revenue for staff development purposes,
2.7consistent with sections
122A.60 and
122A.61, to develop the alternative teacher
2.8professional pay system.
2.9(c) The commissioner may waive the planning year if the commissioner determines,
2.10based on the criteria under subdivision 2, that the school district, intermediate school
2.11district, site or charter school is ready to fully implement an alternative pay system.
2.12 Sec. 2. Minnesota Statutes 2010, section 122A.414, subdivision 2, is amended to read:
2.13 Subd. 2. Alternative teacher professional pay system. (a)To participate in
2.14this program, a All school district districts, intermediate school district, school site, or
2.15districts, and charterschool schools must have an educational improvement plan under
2.16section122A.413 and an alternative teacher professional pay system agreement under
2.17paragraph (b) by the start of the 2014-2015 school year. A charter school participant also
2.18must comply with subdivision 2a.
2.19(b) The alternative teacher professional pay system agreement must:
2.20(1) describe how teachers can achieve career advancement and additional
2.21compensation;
2.22(2) describe how the school district, intermediate school district,school site, or
2.23charter school will provide teachers with career advancement options that allow teachers
2.24to retain primary roles in student instruction and facilitate site-focused professional
2.25development that helps other teachers improve their skills;
2.26(3) reform the "steps and lanes" salary schedule by establishing an alternative
2.27salary schedule that utilizes methods other than seniority and fully or partially embeds
2.28performance pay outlined in items (i) to (iii), prevent any teacher's compensation paid
2.29before implementing the pay system from being reduced as a result of participating in this
2.30system, and improve beginning teacher salaries;
2.31(4) base at least60 50 percent of any compensation increase on teacher performance
2.32using:
2.33(i) schoolwide student achievement gains under section120B.35 or locally selected
2.34standardized assessment outcomes, or both as at least 25 percent of any increase;
3.1(ii)measures of student achievement gains based on section 120B.35 or locally
3.2selected standardized assessment outcomes, or both as at least 25 percent of any increase;
3.3and
3.4(iii) (5) base the remaining percentage of any compensation increase on teacher
3.5performance using an objective evaluation program that includes:
3.6(A) (i) individual teacher evaluations required under section 122A.411 and aligned
3.7with the educational improvement plan under section122A.413 and the staff development
3.8plan under section122A.60 ; and
3.9(B) (ii) objective teacher evaluations using multiple criteria conducted by a locally
3.10selected and periodically trained evaluation team that understands teaching and learning;
3.11(4) (6) provide integrated ongoing site-based professional development activities
3.12to improve instructional skills and learning that are aligned with student needs under
3.13section sections 122A.411 and
122A.413 , consistent with the staff development plan
3.14under section122A.60 and led during the school day by trained teacher leaders such as
3.15master or mentor teachers;
3.16(5) (7) allow any teacher in a participating school district, intermediate school
3.17district,school site, or charter school that implements an alternative pay system to
3.18participate in that system without any quota or other limit; and
3.19(6) (8) encourage collaboration rather than competition among teachers.
3.20 Sec. 3. Minnesota Statutes 2010, section 122A.414, subdivision 2a, is amended to read:
3.21 Subd. 2a. Charter school applications. For charter school applications, the board
3.22of directors of a charter school that satisfies the conditions under subdivisions 2 and 2b
3.23must submit to the commissioner an application that contains:
3.24(1) an agreement to implement an alternative teacher professional pay system under
3.25this section; and
3.26(2) a resolution by the charter school board of directors adopting the agreement; and.
3.27(3) the record of a formal vote by the teachers employed at the charter school
3.28indicating that at least 70 percent of all teachers agree to implement the alternative
3.29teacher professional pay system, unless the charter school submits an alternative teacher
3.30professional pay system agreement under this section before the first year of operation.
3.31Alternative compensation revenue for a qualifying charter school must be calculated
3.32under section126C.10, subdivision 34 , paragraphs (a) and (b).
3.33 Sec. 4. Minnesota Statutes 2010, section 122A.414, subdivision 2b, is amended to read:
4.1 Subd. 2b. Approval process. (a) Consistent with the requirements of this section
4.2and sections122A.413 and
122A.415 , the department must prepare and transmit to
4.3interested all school districts, intermediate school districts, school sites, and charter
4.4schools a standard form for applying to participate in the alternative teacher professional
4.5pay system. The commissioner annually must establish at least three dates as deadlines
4.6by which interested applicants must submit an application to the commissioner under
4.7this section.An interested All school district districts, intermediate school district,
4.8school site districts, or charter school schools must submit to the commissioner a
4.9completed application executed by the district superintendent and the exclusive bargaining
4.10representative of the teachers if the applicant is a school district, or intermediate school
4.11district,or school site, or executed by the charter school board of directors if the applicant
4.12is a charter school. The application must include the proposed alternative teacher
4.13professional pay system agreement under subdivision 2. The department must review a
4.14completed application within 30 business days of the most recent application deadline
4.15and recommend to the commissioner whether to approve or disapprove the application.
4.16The commissioner must approve applications on a first-come, first-served basis. The
4.17applicant's alternative teacher professional pay system agreement must be legally binding
4.18on the applicant and the collective bargaining representative before the applicant receives
4.19alternative compensation revenue. The commissioner must approve or disapprove an
4.20application based on the requirements under subdivisions 2 and 2a.
4.21(b) If the commissioner disapproves an application, the commissioner must
4.22give the applicant timely notice of the specific reasons in detail for disapproving the
4.23application. The applicant may revise and resubmit its application and related documents
4.24to the commissioner within 30 business days of receiving notice of the commissioner's
4.25disapproval and the commissioner must approve or disapprove the revised application,
4.26consistent with this subdivision. Applications that are revised and then approved are
4.27considered submitted on the date the applicant initially submitted the application.
4.28 Sec. 5. ALTERNATIVE COMPENSATION REAPPLICATION.
4.29Any school district, intermediate school district, or charter school that has an
4.30approved alternative teacher compensation plan under Minnesota Statutes, section
4.31122A.414, must submit a new application to the commissioner of education by June 1,
4.322013, that complies with the changes to Minnesota Statutes, section 122A.414, subdivision
4.332, paragraph (b), in section 1.
