1.2relating to liquor; allowing a microdistillery to make limited off-sales;amending
1.3Minnesota Statutes 2012, section 340A.301, subdivision 6c.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2012, section 340A.301, subdivision 6c, is amended to
1.6read:
1.7 Subd. 6c.Microdistillery fee Microdistilleries. (a) A municipality, with the
1.8approval of the commissioner, may issue the holder of a microdistillery license a
1.9microdistillery off-sale license. A microdistillery off-sale license authorizes the off-sale
1.10of distilled spirits produced and packaged on the licensed premises in an amount limited
1.11to one 750 milliliter bottle per customer. Off-sale of distilled spirits shall be limited to
1.12the legal hours for off-sale at exclusive liquor stores in the jurisdiction in which the
1.13microdistillery is located, and the distilled spirits sold off-sale must be removed from the
1.14premises before the applicable off-sale closing time at exclusive liquor stores.
1.15(b) The commissioner shall establish a fee for licensing microdistilleries that
1.16adequately covers the cost of issuing the license and other inspection requirements. The
1.17fees shall be deposited in an account in the special revenue fund and are appropriated to
1.18the commissioner for the purposes of this subdivision.
