1.1A bill for an act
1.2relating to state government; consolidating the Departments of Health and
1.3Human Services; changing the name to Department of Health and Human
1.4Services; requiring a report.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. DEPARTMENT OF HEALTH; DUTIES TRANSFERRED.
1.7(a) The Department of Health and the position of the commissioner of health are
1.8abolished as of June 1, 2012. Duties of the Department of Health and the commissioner of
1.9health are transferred on or before June 1, 2012, to the commissioner of human services.
1.10(b) The commissioner of health, in consultation with the commissioner of human
1.11services, may specify one or more dates before June 1, 2012, on which any or all of the
1.12transfers provided in paragraph (a) will occur.
1.13(c) Transfer of duties under this section is subject to Minnesota Statutes, section
1.1415.039.

1.15    Sec. 2. HEALTH DIVISION WITHIN DEPARTMENT OF HEALTH AND
1.16HUMAN SERVICES.
1.17(a) On or before June 1, 2012, the commissioner of human services, in consultation
1.18with the commissioner of health, shall create a health division within the Department of
1.19Human Services. The health division of the Department of Human Services shall have all
1.20the duties transferred under section 1, except as modified in paragraph (b).
1.21(b) In creating the health division, the commissioners of health and human services
1.22shall have, as their goal, the reduction of agency costs by maximizing efficiency and
2.1providing for optimal coordination between the duties of the former Department of Health
2.2and the new Department of Health and Human Services.
2.3(c) By January 15, 2012, the commissioners of health and human services shall
2.4report to the legislature with a plan to efficiently transfer the duties of the Department
2.5of Health to the Department of Human Services health division. The plan must offer
2.6strategies for reducing agency costs and streamlining agency duties and must include
2.7proposed legislation making statutory changes necessary to implement this section.

2.8    Sec. 3. REVISOR'S INSTRUCTION; NAME CHANGE.
2.9In Minnesota Statutes and Minnesota Rules, the revisor of statutes shall replace
2.10references to "Department of Health" and "commissioner of health," and "Department of
2.11Human Services" and "commissioner of human services," with references to "Department
2.12of Health and Human Services" and "commissioner of health and human services" as
2.13necessary. The revisor of statutes, in consultation with affected commissioners, must
2.14prepare a bill for introduction in the 2012 legislative session making other statutory
2.15changes needed to implement or conform with section 1.

2.16    Sec. 4. EFFECTIVE DATE.
2.17Sections 1 to 3 are effective the day following final enactment.
