1.1A bill for an act
1.2relating to capital investment; transferring money appropriated for the Bayport
1.3storm sewer project to the city of Oak Park Heights for a pedestrian tunnel;
1.4amending Laws 2008, chapter 179, section 22, subdivision 8.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Laws 2008, chapter 179, section 22, subdivision 8, is amended to read:

Subd. 8.Bayport Storm Sewer Oak Park
Heights Pedestrian Tunnel

1.9For a grant to the city of Bayport for
1.10the Middle St. Croix River Watershed
1.11Management Organization to complete the
1.12sewer system extending from Minnesota
1.13Department of Natural Resources pond
1.1482-310P (the prison pond) in Bayport through
1.15the Stillwater prison grounds to the St. Croix
1.16River. This appropriation is in addition to the
1.17appropriations in Laws 2000, chapter 492,
1.18article 1, section 21, subdivision 8, to the
1.19commissioner of corrections and Oak Park
1.20Heights to predesign, design, engineer, and
1.21construct a pedestrian tunnel under County
1.22State-Aid Highway 24 (Osgood Avenue)
1.23from Valley View Park. In addition, the
1.24unobligated amount from the appropriation
2.1in Laws 2005, chapter 20, article 1, section
2.223, subdivision 3, to the Public Facilities
2.3Authority, for the same project the Bayport
2.4sewer project is available for the grant to the
2.5city of Oak Park Heights for the pedestrian
2.6tunnel project. This appropriation is not
2.7available until at least 20 percent of the total
2.8project cost is committed to the project from
2.9nonstate sources.
2.10EFFECTIVE DATE.This section is effective the day following final enactment.
