1.2relating to education; modifying alternative teacher professional pay system;
1.3amending Minnesota Statutes 2010, section 122A.414, subdivision 2.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 122A.414, subdivision 2, is amended to
1.6read:
1.7 Subd. 2. Alternative teacher professional pay system. (a) To participate in this
1.8program, a school district, intermediate school district, school site, or charter school must
1.9have an educational improvement plan under section122A.413 and an alternative teacher
1.10professional pay system agreement under paragraph (b). A charter school participant also
1.11must comply with subdivision 2a.
1.12(b) The alternative teacher professional pay system agreement must:
1.13(1) describe how teachers can achieve career advancement and additional
1.14compensation;
1.15(2) describe how the school district, intermediate school district, school site, or
1.16charter school will provide teachers with career advancement options that allow teachers
1.17to retain primary roles in student instruction and facilitate site-focused professional
1.18development that helps other teachers improve their skills;
1.19(3) reform the "steps and lanes" salary schedule, and prevent any teacher's
1.20compensation paid before implementing the pay system from being reduced as a result of
1.21participating in this system, and;
1.22(4) base at least60 30 percent of any compensation increase on teacher performance
1.23using:
2.1(i) schoolwide student achievement gains under section120B.35 or locally selected
2.2standardized assessment outcomes, or both; and
2.3(ii) measures of student achievement;and
2.4(iii) (5) base at least 30 percent of any compensation increase on teacher performance
2.5using an objective evaluation program that includes:
2.6(A) (i) individual teacher evaluations aligned with the educational improvement plan
2.7under section122A.413 and the staff development plan under section
122A.60 ; and
2.8(B) (ii) objective evaluations using multiple criteria conducted by a locally selected
2.9and periodically trained evaluation team that understands teaching and learning;
2.10(4) (6) provide integrated ongoing site-based professional development activities to
2.11improve instructional skills and learning that are aligned with student needs under section
2.12122A.413
, consistent with the staff development plan under section
122A.60 and led
2.13during the school day by trained teacher leaders such as master or mentor teachers;
2.14(5) (7) allow any teacher in a participating school district, intermediate school
2.15district, school site, or charter school that implements an alternative pay system to
2.16participate in that system without any quota or other limit; and
2.17(6) (8) encourage collaboration rather than competition among teachers.
2.18EFFECTIVE DATE.This section is effective July 1, 2011, and applies to contracts
2.19renewed or entered into on or after that date.
